My partner applied for my I-130 back in June 2022 under my maiden name as that is the name currently in my UK passport.

I wish to get my passport changed to my married name and get a new passport. Will this delay or mess up my visa application? Or will the visa need to be in the name I originally applied under?

You can get a new passport and use it when you apply for the visa . So far you only have a petition   seeking approval to apply for a visa. The only delay would be if it takes a long time to get the passport. It’s worth it so your greencard will be in your married name.

If your spouse applied for your I-130 in your maiden name, your paperwork and greencard will be issued in that name.  Changing your passport is irrelevant now.

Visa must match passport name. If she changes her passport to her married name they will match the visa to the new passport.  Green Card then will also comes in passport name (married name).

 

If you want to use your married name change that passport now. It will save you so many headaches later and a bunch of money.

The above is absolutely wrong.  First, the spouse applied for nothing.  The spouse filed a petition.  When the petition is approved, the foreign spouse is invited to apply for a visa.  It is absolutely ok to get a new passport in the married name and at NVC stage to "apply for the visa" in the new passport name.

Yeah, we are dealing with weird name situation. My wife is Peruvian; they have endless names here but, for example SSA only allow so many letters. So my wife's (this is not her real name) is Milagros Sanchez Dominguez de C.  (or about that). So that's how it will be printed on her SS card....

I had this dilemma too (I am the UK wife, husband lives in US) and so we decided I’d just go ahead and apply for everything in my name name going forward. I got back on 14th September this year from our wedding in to UK and even with all the closures and extra bank holiday for the Queens funeral etc I had new passport, driving licence, banking, electoral register, my nursing registration, dr’s and everything else all sorted and back in my hand in my new married name as of October 4th yesterday. Those 20 days of waiting were worth it for us because now moving forward obviously everything will just be in my new married name. 
 

I applied for a new ESTA in my married name with new passport yesterday and it was approved in 23 minutes even with putting my husband and emergency contact details. Relieved that I can visit for the next 2 years whilst the length I130 / CR1 process now commences for us. 
 

Just coming upon one issue which is that my I94 is only showing old passport and maiden name obviously but I’ll add a note to explain that.
