Traveling Outside the US with expired Green Card and Extension Letter

Hello VJ members,

 

My husband (LPR) and myself (US Citizen) are traveling to the UK in September. We will be coming back to the US on 9/23/22.

 

My husband applied for ROC in September 2020 and thanks to YSC... we are still waiting for his 10 year GC. He has not filed for N400 yet.

 

His conditional green card expired on 10/31/20. He received a 24 month extension letter. (Which is set to expire on 10/31/22).

 

I have a couple questions regarding our travel 

 

1. Has anyone run into any issues returning to the US with one month left on the extension letter?

2. Would it be possible (or necessary) to schedule an infopass appointment and getting a i-551 stamp in his passport?

3. The extension letter is 24 months from the date his GC expired and not 24 months from the NOA date correct?

 

K-1 VISA

1. Not that I heard of.

2.  Possible, not necessary, the extension letter is valid up to the date it is not.

3, correct

Thank you for you advice! In regard to question one I was concerned because I know with passports a 6 month validity is required. Just wanted to make sure that wasn't the case for the extension letter

I feel your pain.  We submitted our I-751 package in March 2019..... still waiting, too.

1.  Shouldn't be a problem.

2.  I don't see a big issue.  You could ask for an ADIT stamp if you want.  USCIS may or may not issue a stamp.

3.  Correct.  The extension letter extends the expiration date printed on the card.  Make sure he has both the expired card and the extension letter.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

The six month thing has more to do when you are leaving the US.  If you as a USC were to enter the US with a passport about to expire you would be fine as well.

 

Regardless, the CBP Carrier Guide shows no qualifications for the length of validity of any document for US entry.

Not to take away from OP’s question, but we have been waiting for 26 months for ROC. Have you attempted to contact them and find out anything?  My husband’s DL expires 9/2022 here in Georgia and we’ve already used 2 extension letters to renew the license.  I did send in an inquiry a couple of weeks ago to USCIS, but heard nothing. Thanks, @Crazy Cat  You can send me a private message if my question is out of place.

Just curious, has your husband thought about naturalization?  I realize this is a personal choice, but something to consider.
