Tourist Visa While Waiting on NVC

Timeline

Hey, just wanted to you get your guys' thoughts and advice on the chances of my husband coming to visit me on a tourist visa while we wait for NVC to "DQ" us. Please advise. He would only be staying for a few weeks, and then returning home.

Yes. Correct. He is not eligible for he VWP and would need a tourist visa, but I am wondering if he has a chance to get a tourist visa. I was reading on travelstate.gov and it stated that the INA presumes that all travelers coming to US on a tourist visa is an intending immigrant and has to prove that they will only stay for a short period of time.

2. He can try get a visa but it will probably be quite difficult to convince them of the required non-immigrant intent when he is in fact waiting for an immigrant visa

Well someone visiting can not also be intending to immigrate.

Timeline

Currently a 100 day wait for a tourist visa appointment in Casablanca, only takes about 90 days to get DQ at the NVC. Think it would be better to save the 160 dollars, and wait to be DQ.

you have already submitted all documents for NVC then wait it out

BTW interview times for spousal visa have picked up and u wouldn't want him to miss the interview in Casa because he was here 

At this time make sure he has the originals of your I 864,  Tax transcripts (Casa now wants copy of the W2 even if u have IRS transcripts) /he will need to take all the originals u sent to NVC like birth certificate,   his passport,  the 2 criminal reports , etc (all with an English translation) and the passport photos 

Prepare him for a good interview

 

Hard for younger adult  to get tourist visa from Moroc especially when they have a US gf or wife

Even my MIL had to apply 2 times to get approved
