Hi Does anyone know if I a US Citizen can make a petition for my Stepson?

And what I need to do? He is an Ukranian minor is in Poland now, his mom is agree to send him here with his father and me. But I really don't know what is the process. Do I need to send a I 130 or I need to send a request to US Embassy in Germany 🇩🇪?

Any help will be appreciated 🙏. Thanks.

Hi,

 

How old is your stepson?

 

A US citizen can file an I-130 for a stepchild if you married the parent before the child's 18th birthdate.

 

Because of the Russian war, you may be able to expedite this case and file the I-130 directly with the US consulate/embassy.  I don't know for sure.  Someone will answer this for you.

Hi, he is 15th now  next June going to be 16th years old. We got married 3 years ago. 

My husband have been in US for 2 years but have the 24th months letter for USCIS.

I have included a link on what Immigration Relief is available to Ukrainian nationals. On page 14 you will see that DOS information . If you , the US citizen go to Europe , then you can file the I-130 at any embassy.

 

If you file the I-130 from here, I am not sure how fast the expedited processing moves, so hopefully VJ members will respond .

You can file a I-130 for your stepson. 

 

You have 2 options: 

 

1)  File the I-130 with USCIS and request expedited processing.  Once approved, you will need to contact NVC and request expedited processing again.

2)  Travel to Europe and file the I-130 directly with the Frankfurt consulate as a DCF case.  The consulate website states they only accept I-130's for spouses, children and parents.  I would contact them directly (which you would need to do regardless for DCF) and ask if stepchildren can also be processed this way.

  • If your immigrant visa case had already been transferred to Kyiv for the appointment and processing, it will automatically be transferred to Frankfurt.

Litter confused now since I called uscis and they said only if live abroad I can fill petition l 130 on Germany. I have to do it here with USCIS ones they send me receipt number I have to call for expedite processing. We'll let see 👀 what happens.

That's correct. If you're not living abroad, you need to file via the USCIS lockbox in the States and then request an expedite.

USCIS is correct in advising OP that for Ukrainians , DOS has made it possible for the US Citizen to go to Europe and file the I.130  ( IR only ) JUST BY GOING THERE in person , look at previous post . OP does not need to live abroad

I think you meant USCIS is "incorrect"

 

Also, "physically present" is not just to submit the I-130.  The petitioner will typically need to be in the consular district for the whole process, up until the interview is scheduled.

I think my only option will be fill l 130 here in the states since the memo said family who have fled Ukraine and my stepson and his family just returned to Ukraine 🇺🇦 It was shocking for us know this now it's going to be a nightmare every day thinking what could happen to them. Thank you for your cooperation. I hope he can be here with us very soon.
