Can you tell me, is that a good thing or the case will be delayed longer?

I asked Sandra a more detailed question, but in case someone out there has the same issue as me, I'd like them to benefit from my question, so here goes:

 

Applied for UVisa in 2018 so it will not be adjudicated until 2024/2025 or even 2026/2027. My lawyer says my daughter who is over 21 and a US Citizen can file Adjustment Of Status (AOS) for me even as we wait for UVisa. I did not know you can file AOS using more than 1 method at the same time. Any thoughts?

AOS paperwork mailed 02/06/13

Text received 02/14/13

Check cleared 02/14/13

NOA1 received 02/19/13

Bio Notification 02/23/13

Walk-in bio 03/08/13

Your lawyer is right, file ASAP since you can adjust immediately as parent of USC, assuming you entered on some sort of visa and not EWI.

Likely transferred to local office for interview or medical rfe if interview is waived. You are almost there.

"They've stolen the dashboard, the steering wheel, the brake pedal, and even the accelerator!" she cried.

 

The 9-1-1 dispatcher said, "Stay calm.  An officer is on the way.  He will be there in two minutes."

 

Before the police got to the crime scene, however, the 9-1-1 dispatcher's telephone rang a second time.  It was the same blonde.

 

"Never mind," giggled the blonde.  "I got in the back seat by mistake."

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I'm really considering that option . How much does it cost in our area? So you hired an immigration lawyer to file mandamus or what specialty I should choose ? I don't think my immigration lawyer knows how to do that properly.

I hired a lawyer With a lot experience on mandamus!

I paid 5k 😭😭😭😭

She told me I’ll hear a good news very soon base on my case that she look at it !

she’s from MA and can help anyone in anywhere in the world

In cases of delayed visas, filing a Writ of Mandamus can force rejection of the visa before internal processes (such as security checks) are completed.  Others here can comment on whether this is potentially true for the cases mentioned here.

Did you file mandamus for VAWA(1-360) decision? Like how much of delay is "delay" enough to file for mandamus? Can you please give your attorney details as well

Yes it was under my vawa case I filled in 2018 and the USCIS only ask for 1 RFE in September 2018 “good moral character” . 
since 2018 I never heard anything from them .

3 prima facie 3 work permit .

my attorney name is Melanie Shapiro her number 781-461-0100
