Interview was scheduled: 02/08/22

File VAWA and ask to hold I-485: 02/11/22


I didn’t go to the interview because I was told so. My lawyer said my current is still valid since we requested to hold I-485 in abeyance. There is still no update on my I-485 but I really want to travel back home. My lawyer said it’s alright to travel but I am still to worried. I entered by student visa but stopped school after sent Aos package. My I-94 still shows “D/S”. Does anybody here have a similar situation? Please share your ideas. Thank you!

THE CLASSY NURSING HOME

 

With their ailing mother needing constant medical supervision, a family decided to bring her to a very expensive and caring nursing home for a day to try it out.

 

The next morning, the nurses bathed her, fed her a tasty breakfast, and set her in a chair at a window overlooking a lovely flower garden.  She seemed OK, but after a while she slowly started to lean over sideways in her chair.  Two attentive nurses immediately rushed up to catch her and straighten her out.

 

Again, she seemed OK, but after a while she started to tilt to the other side.  The nurses rushed back and once more brought her back upright.

 

This went on all morning, with the dedicated nurses making sure that the old woman didn't fall.  That afternoon, the family arrived to see how she was adjusting to her new home.

 

"So, Ma, how is it here?  Are they treating you all right?" they asked.

 

"It's nice enough," she replied, "except they won't let me fart."

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

They went back to the original guidelines on 9/30, so do not get medicals done until they ask for it.

Folks always recommend here to go to interview even if you go alone. You can explain to IO that you are planning to file VAWA. Unauthorized employment and visa over stay is always forgiven for the spouse of US citizen. 

I also traveled to India on advance parole for the first time. So it is safe to travel on AP.

That’s odd . Maybe request congressman help. Mine was filed Sept 2019, approved Jan 2022. RFE on I485 for medicals sent to my lawyer on Sep 3. I replied them already, now waiting for I485 approval. New York City field office.

Hey guys, 

From the information gathered here, i asked my attorney to ask the judge to close my removal proceedings so i can go ahead to file with USCIS. My I360 is pending still for a year. This is what it’s showing me now on my case when i look at the immigration court docket. 
 

Can anyone tell me what it means? We still haven’t received any letters from the court yet.

Just an update from senator's office on my RFE submitted on 04/14/2022... Nothing new lol

On October 28, 2022 The Post Office returned a notice we sent you for your I-485 because they could not deliver it. 

On October, 06, 2022, Card was picked up by USPS

On October 3, 2022, we mailed your new card for your form I-765, Application for Employment Authorization 

On September 30, 2022, we approved your form I-765, Application for Employment Authorization 

On September 29, 2022, we ordered your new card for Receipt #_________, and will mail it to the address you gave us

On August 25, 2022 we updated your date of birth for your Form I-765, Application for Employment Authorization 

April 14, 2022 Response To USCIS' Request For Evidence Was Received

March 15, 2022 We received your correspondence for Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant.

From what I gather the judge probably granted you an admin closure. They're not really supposed to grant a termination without an approved petition. Basically case is still ongoing, jurisdiction over I-485 still rests with the judge, but there won't be any further hearings unless someone moves for a re-calendar.

Probably a request for medical or another document for the adjudication of your form I-485
