Hi all! :) On different parts of the forum show different requirements for the AOS packet, specifically the financial documents, so any input is appreciated!  USCIS website states if you send the tax transcript you do NOT need relevant paystubs, but this info has been debated in the forums.  I don't want to end up with an RFE like many do for sending too much evidence!  We are getting ready to file hopefully in the next week. I (US citizen) am sponsoring my Danish husband, for reference. Evidence pieces are bolded. What we have:

 

  • Cover page 
  • G-1450 (CC auth form for the amount of $1225)
  • G-1145 (E-notification of acceptance)
  • i-148 Adjustment of Status 
  • Copy of Danish Passport and Entry Stamps + visa page
  • Copy of i-129F petition NOA2
  • Original Danish birth certificate
  • Certified copy of marriage certificate
  • 4 passport style photos of husband with A number written on the back
  • i-864 affidavit of support
  • copy of last year's tax TRANSCRIPT with my income over the poverty threshold
  • copy of my new job offer letter 
  • copy of my USA passport bio page 
  • i-765 employment authorization
  • i-131 advance parole

You’re missing your I-94

It’s 6 total, 2 for I-485, 2 for I-765 and 2 for I-131

Are you trying to send this to get an expedited EAD based on a job offer? If so I would hold off until you have your biometrics taken, they won’t issue EAD until you have that. After that I would expedite and provide a job letter as evidence

It's a certified original from the kommune, we got a few for various things. It's supplied directly in both Danish language AND English language.

Are you trying to send this to get an expedited EAD based on a job offer? If so I would hold off until you have your biometrics taken, they won’t issue EAD until you have that. After that I would expedite and provide a job letter as evidence 

 

Each is a separate application and each needs its supporting docs (bio page passport, passport photos etc) 

whoops! i-94 is on my cover sheet and we have everything, just forgot it in my OP.  No, it's MY new job offer as the us citizen, not the foreigners. i got a new job that i am just now starting next week. thanks for the help, this is so confusing.

Job offer is not evidence of current income. Once you start working next week you need to ask HR for an employment verification letter stating how much you make annually (written/printed on official business stationary)

So I should just take it out since my last year tax transcript proves it enough? :c

I didn’t say that. I said you should wait a week and when you start working ask HR for that letter. You can choose to not include if of course, it’s up to you, but it’s strong evidence of current income

You'll likely receive the dreaded generic RFE if you input the amount from your employment verification letter (not job offer letter, that's useless) as current income as you have not yet worked at the job.

Check out the instructions that advise 6 months paystubs "should" accompany EVLs (to prove the predicted amount on the EVL is true/will be true.

If you submit financial documents that don't match the information you input on your I864, yes.

The "they submitted everything but the kitchen sink so what are they really trying to show us?" RFE is very common.

I am in similar boat as AP and very similar packet being prepared, 

 

My fiance never received a physical i94 at the POE, I saw that CBP website you can find the i94, but it doesnt show anything.

 

All she got was a stamp with hand written k1 and the date of April 2022 (I am assuming that is when the visa is now valid till)

 

Is that stamp itself an i94? any response will be appreciated.

  • Feb 14, 2022 = AOS (I-451, I-131, I765) Filed
  • Feb 20, 2022 = Receipt notice for all three received
  • March 21, 2022 = Biometrics in Dallas, Texas
  • August 9, 2022 = EAD (I-751 approved)
  • August 13, 2022 = EAD and SSN received (SSN applied with EAD)
  • September 6, 2022 = AP (I-131 approved)
  • September 13, 2022 = AP (I-131 receieved) 
  • March 15, 2023 = I-485 approved (interview waived, New SSN received without DHS wording)
  • March 31, 2023 = GC in hand (Total time from NOA-1 to GC in hand 794 days)

No. Visa is void once you use it.

Thanks for your response, not 14 days yet. I will wait 14 days and try the CBP website again.

how long until you got married did you submit the documents?

 

My fiance came on 02/01/2022  we are getting married this on friday 03/18/2022 

Im getting nervous since the 90 days are flying by -- havent even done the SSN -

all this time getting a new house, moving, 

 

no need to send pictures in this package?

I filed about a month after we got married, while his I-94 was still valid. A lot of people say you can file AOS from K1 if the i-94 is expired but we did it before just to be safe. We didn’t send any proof of relationship things. You take all of that to the interview.
