Adjustment of Status proof of non working US citizen spouse

Hello. I'm  a US citizen married to a non US citizen who is living with me in the states. We acquired the Spousal Visa and have all paperwork completed for Adjustment of Status except the poof that I'm not working. What can we use for that?

Not sure why you need to prove this, but a simple statement from you indicating such should suffice

On what basis did your spouse enter the USA?

 

Who is asking for your proof of not working?

If he got here on a spousal visa, you don’t need an adjustment of status or show a proof that you’re not working.

This is extremely confusing and you need to clarify. From your January thread, it sounds like you guys filed I-130 and got the receipt notice. Your husband then entered the US with a tourist visa and you guys changed your mind and decided you want to do Adjustment of Status. If this is all correct, then you guys never acquired the spousal visa. You only filed the papers for it, which is not the same as actually getting approved for it. Also, if this is correct, then yes, you should file Adjustment but Adjustment does not require proof that the immigrant and/or the US citizen is not working. That is not requested at all in any of the Adjustment forms so I have no idea why you think you need that "proof", especially since you are the US citizen. Makes zero sense for USCIS to request that from a US citizen.

Sounds like you'll need a qualified joint sponsor with an I-864 and supporting financial documents if you're not working.  Unless you are using your own assets for the I-864.  If you're asking for how you can explain on your I-864 as the principal sponsor (always required from the USC spouse) why your current income is zero, just explain it in the other comments section at the end of the form or attach a letter.  Good luck with the AOS process.
