AOS Name change? when to do it?

In my case, I changed my name in the court after my EAD was issued with my old name. I was able to change my name in my SSC, by just sending the court order and the EAD with the old name (and a copy of their instructions to make sure they wouldn't deny it again).

My I-94 was still valid, but I was told that there was a mismatch of information, and that it would be easier to wait for my EAD. I was fine with waiting because I couldn't work or anything yet anyway. Once I had my EAD it was super easy to update.

They did the same thing to me the first time I applied. Second time I sent a copy of their own instructions manual that says

 

"The only time you may process an SSN application in a name that does not agree with the name shown on the immigration document is if the person legally changed his or her name after the immigration document is issued. In these situations, the legal name is the name shown on the evidence of the name change. For information on evidence of a name change, see RM 10212.010."

 

Got the card 2 weeks later.

I filed my AOS/EAD/AP in my new married name (my SS card still had my maiden name), and I included my maiden name under "previous names used" in the forms. My EAD/AP arrived in my married name. Then I went to the Social Security office to have my name changed on my SS card, using my EAD/AP as proof of status and name, plus my marriage certificate. I have had zero issues. It takes a while, but everything in this immigration process takes time.

Thanks for clarifying this.  We will complete AOS with the new maiden name and submit out marriage certificate with both our maiden names on it. We will also request on the form to have ssa send us a social security card which will have the. Ew na.e on it because she ready received her ss card with her maiden name.

So can I just request ssa to send  new ss card on the AOS application?

This is not a thing.

 

Marriage certificates are issued in the current legal names of both parties (i.e. 'maiden' name).  If one party chooses to begin using the other person's name, the MC is the document used for this.
