Change of address? Form I-865? HELP

Hi there,

 

I am the beneficiary and I have a pending AOS. I recently moved with my wife (petitioner) and I filled the for AR-11 online, do my wife (the sponsor) has to file the form I-865?

If your wife has previously submitted an I-864, then yes.

OP's AOS is still pending, so the I-864 is not yet in force.  No need for I-865 yet.  Sponsor's new address should be recorded in an updated I-864 for the AOS interview.

And if the interview is waived?  The instructions say "If, at any time in the past, you have completed an I-864....."

That would be lucky 😀  Anyway, submit an I-865 if there is no opportunity to provide an updated I-864 before AOS approval.

It would be nice if USCIS made the I-865 an online option (We just moved....LOL).

With AR-11 filing already available online, you'd think it shouldn't be that hard to do the same for I-865.  But who knows with USCIS... 🙄

NO. Your wife needs to file form i-865 only if you become the LPR.

Send it in with case numbers of any pending forms (AOS, EAD/AP). You never know, it may just trigger USCIS worker to get to your case faster.

I865 instructions.

 

If at any time in the past you completed Form I-864, Affidavit of Support, to sponsor an immigrant, you are required to report your change of address within 30 days of the change if the sponsorship agreement is still in force.

 

You are not the immigrant yet so i864 agreement is not in force. In fact your wife should NOT submit the i865 before your i485 is approved. I865 asks for the sponsored immigrant info and your wife cannot put your info since you are not an immigrant yet.

Ehh, try again! I don't know how you can jump to these conclusion with what's written on the instruction.  ''if the sponsorship agreement is still in force.' it's already in force, I don't have to be approved to have him as my sponsor. Your explanation is far-fetched

I used I-865 to change my address twice as the petitioner even before any I-864 was completed (still not completed). Sending I-865 will not harm any process.
