Tourist visa expiring but I94 has different expiration date

Hello!

 

I will apologize in advance if this has been asked before. I looked through the forum and wasn’t able to find the answer I’m looking for. 
 

My husband is here in the US visiting me and his visa expires on August 7th. When we looked at his I-94 he was given the normal 6 month stay which is until January 22….he will be leaving in august regardless but have seen mixed information. 
 

Does he need to leave before the visa expiration date or the I94 date?

I believe his visa doesn't not expire soon or he would not have been let in.

So the answer is I-94.

You can be let in up until the day your visa expires…I believe his visa expiring next month wouldn’t have affected his entry

His status in the US is defined by i94 not the visa. If he's returning back in August solely because of expiring visa, no need to do so.

Visa expiration has nothing to do with stay period. Even if you show up at POE a day before expiration of visa, you are still getting your 6 months stay period if deemed admissible.

I94 - this is what shows his period of authorized stay. The visa expiring just means he needs a new visa before the next time he enters.
