Unemployment and Removal of Conditions

Timeline

Good Day! I hope all are well. So recently my husband and I were able to buy our first house. We will be moving across country to another state and currently do not have jobs there but do have money to sustain ourselves for a little bit. (We are not concerned about finding jobs, we both have degrees and experience and don't think we will have a problem). But, in the mean time, I will leave work next week and he has already left work. Would it be okay to collect unemployment during the moving phases of our journey up until we find a job, or will that show as a big no-no when it comes to our removal of of conditions? Would it also matter when he applies for citizenship next year. 

 

Side question, if we don't finish the permanent resident yet (still in the waiting phases) can he still apply for citizenship next year, I think according to our timelines, he should be at the stage where he can apply for citizenship by then.

Jul-31-2018 - Mailed AOS Package (I-485, I-130, I-765, I-131)

Aug-02-2018 - AOS Package Delivered (According to USPS) 

Aug-09-2018 - Email & text notifications package received, money orders cashed 

Aug-13-2018 - Hardcopy NOA for I-485, I-130, I-765, I-131 

Aug-17-2018 - Biometrics Appointment Letter Schedule

Aug-28-2018 - Biometrics Appointment Successful 

Nov-01-2018 - Change of Address Forms Sent

Nov-06-2018 - 90 Days since application received USCIS

Dec-13-2018 - Text Notification about Scheduling Interview

Dec-19-2018 - Text Notification that the EAD card is in Production

Dec-21-2018 - Text Notification that EAD card is on its way - arrive before Jan. 5

Dec-22-2018 -  Hardcopy Letter EAD and Advanced Parole card on its way

Dec-28-2018 - Received EAD/AP Combo Card

Mar-19-2019 - Received Email that our interview was scheduled. Waiting for the Hardcopy NOA

Mar-25-2019 - Received the Hardcopy NOA - Interview is Scheduled for May 2

May-02-2019 - Had Interview was Successful

May-06-2019 - Received Hardcopy Letter of Approval in the Mail

May-07-2019 - Status change - You will receive your Green Card by May 22, 2019

May-13-2019 - Card was Delivered to me by the Post Office - I-485

 

Petition to Remove Conditions -> I-751

February-02-2021 - Window to File Opened

March-05-2021 - Shipped package to Arizona dropbox via UPS

March-09-2021 - Package arrived to USCIS according to UPS shipping

April-07-2021 - Package returned due to Rejection - Outdated Forms

April-08-2021 - Shipped package back to Arizona after making corrections

April-12-2021 - Package was Received

April-30-2021 - Received the text message that the package was received and the check has been cashed, Back on Track, NOA Received with 18 months extension letter

May-11-2021 - Received Notice of Case updated to show fingerprints were taken

July-04-2021 - Moved and sent in Change of Address Form, NOA response immediately online

November-09-2021 - Received Second Extension Letter for 24 months

December-14-2022 - Received Permanent Resident Green Card

I-751 is about the bona fide marriage relationship.  There are no financial requirements other than to show co-mingling, so you will be fine if you have lots of evidence since the date of marriage until filing the I-751.  Same for the N-400, no financial requirements like adjustment of status, no I-864.  So the period of unemployment will not be a problem at all.  Yes, you can file the N-400 while the I-751 is still pending, as they are taking 1-2 years to adjudicate I-751s these days, many do this and end up with a combo interview for both.  Good luck!

If I’m not mistaken, collecting unemployment is only possible when you are let go or fired from a job, not when you voluntarily leave. So you might want to double-check if you’d be elegible for it to begin with. But if you were, it would not impact his ROC or naturalization processes.

09/25/20: AOS package (I-130/I-485/I-765/I-944) mailed out via USPS.

09/27/20: Package received by USPS.

10/24/20: Received NOA1 in the mail. PD is 09/28/20.

01/05/21: Biometrics appointment completed (Brooklyn ASC). Case updated to show fingerprints were taken (I-486 & I-765).

01/05/21: I-131 mailed via UPS.

01/17/21: Received IOE receipt number for I-131 via text.

01/25/21: Received a biometrics reuse notice for I-131.

02/02/21: I-485 Case is ready to be scheduled for an interview.

02/04/21: Received I-693 deficiency notice in the mail (dated 01/29/21).

02/09/21: Advance Parole document was produced.

02/16/21: AP in hand.
02/26/21: New Card Is Being Produced (EAD).

03/04/21: EAD in hand.

09/01/21: EAD renewal paperwork received by USCIS. IOE receipt number.

09/07/21: Receipt / 180-day automatic extension received in the mail.

09/09/21: Received a biometrics reuse notice for I-765 renewal.

10/25/21: AP renewal NOA and biometrics reuse received in the mail.

11/04/21: Interview was scheduled for 12/02.

Agree.  

1.  There is no public charge consideration for Removal of Conditions or Naturalization.

2.  Unemployment Insurance is not a public benefit.  It is insurance paid by the individual employer/employee.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Collecting unemployment will have no effect on ROC or N400 processing. Voluntary relocation won't qualify for unemployment benefits imo.

NJ benefits for unemployment are as follows:

Unemployment Insurance benefits are meant for people who lose their job “through no fault of their own,” such as an employer’s lack of work or a layoff due to downsizing. If you voluntarily quit your job for reasons that were not work-related, or you were terminated for misconduct, your eligibility will need to be reviewed.

 

and you will not be eligible   for benefits from the state you are moving to "as not worked in that state"
