N400 with pending i 751 and waiver

Hey everyone so I have a bit of a tough situation to figure out and I'm hoping someone on here can help.

Here is my brief timeline

 

Dated for over 7 years, 

Applied for and was approved for Cr1 GC in 2016.

Marriage ended in early 2018 a few months before the 2 year mark.

Filed for I751 with divorce waiver in august 2018  

Received notice of action

Never received biometrics appointment

Case status still states, Finger print fee received

I've had infopass appointments, received the i551 stamp in my passport twice now, but case is still pending with no action taken only moved from CA to NE late 2019.

 

This august i will have held my status for 5 years since it was granted in 2016.

 

So my question is, with my pending i751 am i eligible to file N-400 even though I'm still technically only on a CR1? But i will have had that status for 5 years due to the massive delay on my case. 

I'm hoping that filing the n-400 will give my case the shove it needs to move along. 

I'm not worried about proving the was entered into in good faith. As stated we were together for 7 years prior to marriage, and i submitted ALOT of proof of our legitimate married life, it just didn't work out as we had hoped.

Yes you can file N400. If you happen to be interviewed for N400 prior to ROC approval, it may trigger some push on ROC processing or they could also be approved together however you N400 won't be approved before ROC is approved.

I agree, assuming you meet all the requirements for the 5 year N400, file it and get that clock running.

Yes - you can apply 90 days prior to your fifth anniversary of gaining your permanent residence.

Hello, I have almost the same situation but there’s one difference which’s I just filed for ROC last February (2 years and 6 months after the expiration date of my GC)

I’ll hit the 5 years anniversary in a week or so, should I go with my n400

I would probably file n-400 if it was me, but that would depend on while I filed I-751 2.5 years late.

Итак, мой вопрос: с моим ожидающим i751 имею ли я право подать N-400, хотя технически я все еще использую только CR1? Но у меня будет этот статус в течение 5 лет из-за огромной задержки по моему делу. 

Я надеюсь, что регистрация n-400 даст моему делу толчок, необходимый для продвижения вперед. 

Я не беспокоюсь о том, чтобы доказать, что договор был заключен добросовестно. Как было сказано, мы были вместе 7 лет до брака, и я представил МНОГО доказательств нашей супружеской жизни, это просто не сработало, как мы надеялись. 

did you fly with a stamp I551 in your passport on vacation or to your homeland?

If it’s a divorce waiver filing, it isn’t considered late.

My attorney kept telling me not to, I have my biometrics appointment for the i751 within a week

Nope. As stated, a waiver filing being filed ‘late’ isn’t actually late as it is permitted to be filed at any time. 
If your I-751 has been filed and you are n-400 eligible, and you want to file, then do so. There is no bad situation or reason to prevent you from doing so

It depends on why the I-751 was filed late.  
 

Also reportedly with some field offices,‘filing the N-400 before I-751 has been adjudicated will slow down I-751 

 

 

As I wrote before, I would be inclined  to file N-400 now.  But that is absent missing information and with more data my decision might change.

Correct, as previously stated. 
Divorce waivers can be filed at any time, without prejudice or penalty and without requiring a valid excuse request for filing outside of the 90 day window. 
It is not considered late.
