Can my co sponsor owe taxes?

You need to clarify.  Everyone owes taxes.  Do you mean a tax lien of some sort?

Having a balance due on the current year return is not a problem,  if it was, possibly upwards of 50% of USCs would be ineligible to sponsor

YMMV

Another question, since our co sponsor wont be able to get a tax transcript in time for our interview, is it ok to bring 1040 ?

You can't bring what you don't have or can't get, however,  does your consulate have specific instructions regarding the financial ability?

Typically the 1040 needs to include not just the 1040 form but also all schedule attachments,  as well as w2s or 1099s, if any.

The instructions we received from the embassy just says to bring for i134 not any specific documents.

Our co sponsor is a business owner, so he doesn't have w2s and states he does not have 1099

He has just completed his tax and sent it over right away, it includes of  form 1040, schedule 1, schedule B, form 8895, and form 4562

Should I just use all of these documents he sent over?

Has the co-sponsor already filed taxes and it has been processed? If so, they can easily get transcripts online through irs.gov.

nope,  they are way behind in doing tax returns because they had to process the 2 stimulus payments

so some are still trying to get 2019 transcripts

Then just use a copy of the COMPLETE tax return, W2s, etc.
