How do I file my taxes with a spouse who is not yet a resident at this time?

I know it's late,  but I was in rice exact same situation last year. Finally got SS office to make an appointment in August.  Did not file taxes until we had those social security numbers. 

 

I'd do as HRQX said above. I too use Turbo Tax.

 

Don't file separately.

Thank you for letting me know it's not a rare case!

What I can try is probably mail the extension and hope it arrives.

 

I called the local Social Security Office and they had been giving inconsistent answers, but apparently there was an SSN issued but the process was not finished by the USCIS (parents info were blank from their record), and now they want to me to call the USCIS to ask what was going on. I don't even know who I should ask on the USCIS end. It was also frustrating that they only want to talk to the actual applicant and I couldn't do that much by my self.

Oh, I forgot about USCIS. I too checked the box to get ssan at same time,  but since we were approved,  they decided that that form was moot and therefore never sent info to social security administration. 

But by then,  March 2019, social security offices were closed because government workers get paid whether they work or not, but I was able to beg an appointment,  which finally happened in August.

Perhaps file for extension and find a CPA to help you. It will give you more time to file a correctly filledt tax return.  .  First thing I did was to  apply for SSN when my fiance arrived US and by the time tax day came she had a SSN so it was simple filing jointly.    visajourney  has step by step guide that recomnend this.

I am in the same boat @Chris Chen

 

Ended up printing the extension form as mentioned and noting that we are still waiting on the SSN. I read elsewhere that it is possible to file MFS and later amend to MFJ, which might be an option for some.

 

@poh I don't understand this option. Since we are waiting on SSN from the AOS application packet, is it even possible to get an SSN any other way?

K1 visa holders are eligible to apply for SSN until day 76 of their US entry.  If they don't get their SSN within that short period, they'll only be eligible for SSN after getting their EAD or GC.

That checks out with what I was thinking. We are F1 one so it sounds like we are definitely in the EAD boat. :(

 

At this rate I wonder if we run the risk of not having it by the October deadline. Processing times for us have been moving goalposts. It said 4.5 - 5.5 months when we apply. Now it says 5.5-10.5.
