They should be held accountable for all this. My brother in law did his DURING covid all done in 8 months yet the rest of us still here a whole yr later.

Worst is, during Covid it was also Trump administration that supposedly hated immigrants :D, and processing was miles faster than these times under "pro immigration" democratic administration :D.

December 2021 - Travelled to the states on ESTA

June 2022 - K1 approval

September 2022 - NVC case number

October 2022 - Case sent to the embassy

November 2022 - Postponed interview for 1 year - Couldn't leave country yet due to work obligations

November 2022 - Travelled to the states on ESTA - 2nd time

September 2023 - Resumed case / took medical

October 2023 - Embessy interview - Approved

December 2023 - Arrived at the states

February 2024 - Married

March 2024 - AOS/EAD/AP filed

March 2024 - Biometrics 

May 2024 - EAD - AP Combo Card Approved

I got tired repeating this... He did this during covid translates as USCIS did not have a backlog back then. Now they do.

Do we realise there are people waiting for this since March 2021? 

As i said before we did not "pay" someone to do something. America has a closed immigration system. Its not like europe where we can freely move from one country to the other and work freely if we have an eu passport. US wants to control who comes and who goes with either visa or esta and also they want to control who lives in their states.

Therefore, we do not "pay" them to do a job for you, we "apply" to have your fiance accepted to live and work in the US. They have the right to decline and they do not have to even justify on what base they declined. Its what we have to go through since we chose to live there.

However, one can always appeal their denial. Now, when it comes to lawsuits, eligible to sue is any person who has properly filed an application for a benefit, whose application has not been decided for an extended period of time.
The USCIS publishes “processing times” (https://egov.uscis.gov/) which can be used as a guide to what is a “reasonable” period of time. And that is why they change the processing times, to avoid lawsuits

 

It's not ideal for any of us waiting for more than a year. It needs patience and if we cannot endure this are we sure we are ready to be married? Waiting 1 year+ is nothing compared to the rest of our lives

Update for may 26th 2022 so far (not end of day, but shouldn't be too far off):

 

3 people with a receipt date of May 3rd was approved today! Not expedited cases, just normal may 3rd cases!

(It actually may be 4, but I don't know the receipt date on the last one since the previous update was a 'Date of Birth Was Updated' from 2021 so it could've been an April case.

 

 

So far today there has been 120 updates in April + May + June, a whopping 75 of those were approvals!!

Let me give you a negative note :D Today will be a record day, there are huge number of approvals in April, it is even more than that was this Monday (i just ran the numbers). Now what is the bad news, on Monday is a Memorial day, federal holiday, so USCIS is closed and tomorrow is Fridays, and probably half of USCIS will be on holiday and will process very little cases, so I know that I will be disappointed :D Next week will also be terrible, because many of USCIS staff will probably have holiday.

Yes that's true. However, if they keep this speed once they're back from vacation then I won't complain ;)

So, it's not a staffing issue.

This is my biggest gripe. If we had 3 weeks of this kind of processing, they would process entire April and May with ease.

Sadly, during all this waiting, and seeing these flashes of insane processing rates, I know what will follow, 2-3 weeks of terrible processing. Last time when this happend was on 14-16 February, I had may hope so high during those 3 days, what fallowed was crushing slowdown. I cant believe it was 3 Months ago

Now we know how they work, im not saying to be negative but be realistic. And this is USCIS the worst they can do won't surprise us anymore.

For you it may be a year this is my fifth year due to other paperwork issues. So yeah being desperate at this point I believe it's pretty reasonable.

I am sorry, what you wrote is simply not true. USCIS is funded solely by fees of applicants so your paid to US government to process your case, we are not getting a handout but expecting service from our government that we paid for.

Also, comparison with Europe is not appropriate, because USA is of similar size and has 50 states that make the Union, you can move between the states. In Europe every country has its own immigration, and when you are not from EU member state you go trough the immigration process that is 3 times faster. Friend of mine started process of getting his fiancé from China to Germany one month after me, and they managed to finish it in 4 Months, we are waiting 12.

 

Also it is easy to be motivated when you are sitting in EU member state that can get easy trave to USA without visa. There are couples that are from countries like Philippines, China, Bosnia or other countries that need tourist visa to do basic visits and in these countries wait for tourist visa can be Months long. In my case, I am stuck in China due to lockdowns and Covid measures and even though I have tourist visa, I cannot leave. I have not seen my fiance for over 2.5 years now, and we are 5 years in relationship and used to live together for 2,5 years, we had wedding planned for February 2020, tell me how not to get frustrated.


We need to understand each other situation, and not just make blank statements how we need to be patient.  For example Philippines even after they get NOA2, they have to wait months for Visa Interview, what puts their total wait to over two years.
