Identity Document for naturalized daughter

Hi guys,

 

I told my step daughter to get her learners permit and was not able to proceed because we don't have an identity document for her.  She and her mom came to the US in 2011 via K1 and K2 visas. They got their US citizenship in 2017. Mom got her documents at the searing in ceremony but nothing was provided for the daughter.

 

Now the MVA says that she needs and identity document from USCIS. I have been away from USCIS and the immigration progress since 2017. What form do we need to submit to get proof of identity for my stepdaughter?

If your daughter was under 18 years old, had a green card, and was living with her US citizen mom, then she automatically derived US citizenship.

 

When your wife naturalizes, nothing is provided for her daughter.   Her daughter is not naturalizing.  She is automatically deriving US citizenship based on the Child Citizenship Act.  Using the mother's naturalization certificate, the daughter can obtain an N-600 and/or a US passport as her proof of citizenship.

That's the problem. It's not. When we went thru the citizenship process only the mother was given any paperwork. From what I read it was stated that a child on a K2 visa is granted citizenship based on the mother. USCIS did not provide any papers for the daughter.  So my question is how do I get that documentation? Which form do I fill out and what is the process?

So it is a N-600 that she needs to obtain. And if I understand you correctly, we can apply for her to get a US passport based on the mothers naturalization certificate?

Get her a US passport.  This page lists the documents required from those who derived their US citizenship through naturalization of a parent -- https://travel.state.gov/content/travel/en/passports/how-apply/citizenship-evidence.html

No, a child on a K-2 visa IS NOT GRANTED citizenship based on the mother.  A child who is a green card holder, is under age 18, and living with a US citizen parent is granted citizenship based on the parent.    A significant distinction.  

Read the instructions for form N-600.  Read the instructions for obtaining a US passport.  You can do both or save yourself some money and just get the US passport.

Was your step daughter under 18 years old when her mom became a USC?

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

I'd go for this. But it's upto OP

She can get one if she wants, but it is not required.  US passport is sufficient proof of citizenship, and seems to be easier and faster to get.  Estimated processing time for N-600 is 7.5 to 13.5 months (at Baltimore MD local office).

Yes, her mother's. I should add that this requires the daughter to have been a greencard holder before, or she never became a citizen when her mother did.
