I am reading between the lines and this story isn't adding up. Hate to make assumptions, but I'll apologize if it later turns out that I was wrong. Anyway, my assumption is that OP is the immigrant and not AA as earlier claimed. As such, the storyline is inverted (hearing it from immigrant viewpoint). 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Hi OP,

You will need to fill out several forms:

I-130 and the subsidiary I-130a

i-485

i-864.

Each form Has instructions on the USCIS website as well. Please read Those carefully, and make sure you include all the necessary documents.

Somebody linked the visa journey guide. Read it thoroughly.

FROM F1 TO AOS

October 17, 2019 AOS receipt date 

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

Not if they are filing for a CR-1. The I-485 would not be filed, and the I-864 will need to be completed at a later stage. I'm still not quite sure exactly what the situation is and what they would be filing for though...

Thank you for the correction! So the only one would be the I-130?

It's extremely rare to get a K-3 visa.  

Your spouse will have to go through the I-130 process and get an CR-1/IR-1 spousal visa.

 

If you want good help, you will need to give us a timeline of your immigration.

 

When did you get your green card through marriage to a US citizen?

 

When did you obtain US citizenship?

 

When did you divorce?

How did you meet your current wife?

 

Did you know her before immigrating to the US?

my final Divorc date 11 Sep 2020

I meet her through a friend

No i dont know her before

Okay.  You will not need a waiver to file the I-130.  Just need the I-130 and I-130a to start.

You can upload the I-130A with all the other documents you will upload as evidence.

If you are married its better to just do the I130
