Hi all,

 

I arrived in the US fairly recently and my fiancé and I are getting married next week and will then submit the paperwork for my AOS. I quit my old job (literally last working day was the same day I arrived in the US), but my old company is international and has several US offices. My old manager texted me today and said they are going to be doing new rounds of hiring in the upcoming months and that there are some roles that his US counterpart wants me to apply for. 

 

I have read that if you receive a job offer, you can use this to expedite the processing of your EAD. Is this legitimate? Can any advise how much this will actually help speed up the process?

You can look up the reasons to expedite, the usual one is financial hardship. Is that the one you are considering?

That's probably the only one we could maybe fall into, but even that is a big maybe. My partner and I are both unemployed (she's studying for her MBA) but both of us have a fair amount of assets in our names so that may be a difficult thing to prove 🙄

Costs nothing so why not give it a shot?

We definitely will! Just wanted to get a sense if others had tried it before and how much of a success it had been in helping them get their EAD sooner :)

Usually people have a concrete job offer or can demonstrate hardship. Your case is slightly different in that your former boss has informally given you the nod that they will be hiring soon. If you could get something more official and firm, it would certainly help your case.

Some people have had success .......the time until card production has varied.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

What have you got to lose? Presume it is not a big issue as you are doing the K1. So it is a bet against nothing

I was in the exact same situation a few years ago, moved to be with the missus-to-be, company was keen to keep me around. I could have come on an L1 visa and pretty much started working day one, but figured K1 was a faster route to green card, so I decided to stick with that despite the wait. As it were the wait ended up being almost 6 months, I did try to expedite sending a copy of my formal job offer, but that did absolutely nothing. These 6 months also happened to be Trump's first 6 months in office which didn't help USCIS processing times... :) Doesn't hurt to try for sure.

Most of time USCIS will want biometrics to be taken by an ASC in the US before issuing the EAD. That may be a hurdle in your expedite attempt.

You can try, but it will most likely be denied. They need biometrics to issue the card. And biometrics are taking 3-6 months to be scheduled depending on the location. So since you haven't filed yet, it will take some time before you can actually request to expedite you EAD.
