Applying Citizenship

Hi everyone,

 

I was on a citizenship interview last week, the officer asks me what type of visa that I came to the US. I came in H4, my husband was an h1b, he was interviewed back in January before me and he has been requested document to get approval until now he has not gotten any update. My interview went well I answered all correct, but the officer said that she can't give me citizenship because my husband’s case has not been reviewed and approved yet. So my question is that do I related to his case, that the reason I need to wait. Is it just a normal case?

What was the document requested from your husband? Once you each had 10 year green cards your paths should have been independent - so was there some question about the prior validity of his H1 status that would by extension have affected your derivative H4?

Thank you so much for your response. My husband has been requested for his school transcript and certificate degree, he came as F1 and then to h1b. He has submitted all these.

Yes, that’s normal for a green card based on employment. So I am confused as to why they want to wait for your husband’s decision to decide on yours. Did you guys do adjustment of status? Was there any question about valid status at any point before that?

No, we did not. They didn't ask me about it, but about my husband's job and green card approval. I answered all correctly. Most of the questions were related to my husband.

As they say, the naturalization process is their last chance to check the entire immigration profile. You got your GC because of your husband so I would assume that USCIS want to re-check the approval of the GC. Did your husband just get a certificate from school or something more?

Yes, this. They are more thorough with n400 applications than green card ones. I find it strange (both my spouse and I having been through this process so I know what we were asked) that most of the questions at the interview were about the husband, his job etc. it certainly seems to show some question/re-examination over how he got the green card originally.  Hopefully the evidence submitted will be sufficient to sort it out.
