I'm confused since we are in the beginning of this year is 2020 tax year is the most recent tax year or it still 2019 until 15 April 2021 ?
2nd question

since I'm not  going to send tax transcripts for my 2nd and 3rd most recent tax years, I still have to fill part 6 line 24.b,c ?
I found this in the Instructions but still confused. if I fill 24.b,c is that mean according to the Instructions below that I choose to rely on income from the three most recent tax years? so later they will ask me to provide them with tax transcripts for 2nd and 3rd years ?
it looks like the line 24.b,c boxes are optional, what do you think?

Even if you submit only the most recent tax documents, yes, you still have to enter the information for items items 24b and 24c. Those items are NOT optional.    The most recent tax year is 2019....until April 15th, 2021.

 

The only reason to omit items 24b and 24 c would be if you were not required to file taxes for those years (and you didn't file).  Then, you would have to explain why you were not required to file for those years.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

so i have to wait until 15 April before i sign form i-864? because my 2019 income not enough.

No, you do not have to wait.

Current income is king....not income as reported on previous year tax returns.  Current annual income is calculated by:

current weekly income x 52 = current annual income

current monthly income x 12 = current annual income

current pay period income x number of pay periods per year = current annual income

Are you self employed? Current annual income is totally separate from tax returns....unless you are self-employed.

no I'm not self employed, I meant my current annual income will not change and it will be the same amount of total income in my W2 for 2020.
but what happen if i singed and sent i-864 with 2020 tax document before 15 April. it will refused ?

You don’t need to wait. Your current income (as evidenced by recent pay stubs/employer letter) is what matters. 

09/25/20: AOS package (I-130/I-485/I-765/I-944) mailed out via USPS.

09/27/20: Package received by USPS.

10/24/20: Received NOA1 in the mail. PD is 09/28/20.

01/05/21: Biometrics appointment completed (Brooklyn ASC). Case updated to show fingerprints were taken (I-486 & I-765).

01/05/21: I-131 mailed via UPS.

01/17/21: Received IOE receipt number for I-131 via text.

01/25/21: Received a biometrics reuse notice for I-131.

02/02/21: I-485 Case is ready to be scheduled for an interview.

02/04/21: Received I-693 deficiency notice in the mail (dated 01/29/21).

My suggestion is file your 2020 tax return as soon as possible, (probably very early February) so that 2020 is your most recently filed tax return.  "The most recent tax year" is a phrase you made up, not part of any I-864 instruction.  Your current income is NOT the total on your 2020 W2 form.  As has already been explained slightly differently, it's the gross for a pay period times the number of pay periods in a full 12 months going forward.

 

You could have zero current income today, if you lost your job last week, and then have a totally different current income if you start a new job next week.

 

Current does not mean last year.  Last year is the past.

The issue or current income is confusing,  when I was doing my AOS, I put my petitioner latest /recent tax return figures as  current income and when I also did my son I-864 i did the same and all were approved by USCIS and NVC

My understanding is taxes are always in arrears, so as of 2021, the latest tax will be 2020 taxes. 

And I also have the understanding that , I could not use my current employment pay as current income WHY? Because I have not yet earn it.

However , I have seen 90% of people use what they expect to earn as current income and it all went well with them.

Am not in anyway suggesting u do what I did, but just sharing what I did and the logic behind it.

That is  illogical.  What if I reported $100,000.00 on last year's tax return, but lost my job last week?  What is my current income?  It is $0.00. It certainly isn't what I reported last year...... Can a sponsor support a new immigrant on $0.00?   That is why CURRENT annual income is calculated going FORWARD......not what was earned in the past.  The Consulate Office or Immigration Officer wants to ensure you have the ability to support the new immigrant in the future.

May be you did not read my message well. I never said I read it anywhere.  I just said my understanding of Current income .

Again, I use the same logic to fill my I-864 when I was doing my AOS and I did the same with my Son's case.  All went well. Both USCIS and NVC approved it.

I made it clear that am not saying X or Z should do the same , but am just sharing what I did.
