Urgent help need! What means “if required” at Green card interview notice?

Hi folks!

 

Need your advice!
 

My I485(AOS) interview will be on Jan 20, at the notice first page “you must bring the following items with you”:

If required, a completed form-I693...

If required, a completed form I-864...

 

I do not see these 2 items on 2nd page of the interview notice, does that mean I am not required to bring them?

 

 I am worried if I am required, I may not have enough time to prepare before the interview! I received the notice late because my address changed when the notice mailed 🥲

If required means if you haven't submitted it.

That is generic information that does not apply to all cases.


For example, a minor child of a US citizen would not need an I-864 since the child would automatically become a US citizen upon getting a green card.  A person who has 10 years of Social Security work credit who is adjusting status would not need an I-864 either.  
 

Some cases needs those documents.  Others don't require them.

 

Depends on your case as to whether they are required or not.  

If you are adjusting based on marriage to a US citizen, then those documents are required for your case.

Yes I am adjusting based on marriage to a US citizen and we do not have kids. So I am required for both! Gosh I don’t know if I get enough time to do Form I693, the medical examination 🥲 I will check right away!

You didn't answer my question.   Are you adjusting from k1? Else?

I'm bored so I looked through OPs other post and it seems OP came here on a K1.

 

If that is correct OP then you don't need to do another medical cause you already did one in your homecountry to be able to get the visa. Giving the fact that the vaccination part was marked complete you're fine.

Also for the I-693 and the I-864 it says 'if not already submitted'. You submitted both already. The I-693 was in the envelope you handed over at CBP and the I-864 was sent with your application.

Yes I adjusted from K1. I did make the examination in my home country, then I moved to US, we married on Dec 8, 2018 and we submitted the AOS  at Jan 2019, the interview will happen after our 2 year marriage(also means the medical examination is more than 2 years).
 

I-864, I do know we submitted affidavit of support from my husband’s before, but he is unemployed right now, do I still need to submit this form from my part( I have a job)?

 

I am sorry for so many questions here! I am very stressed out because it so rush to the interview! 🥲

Doesn't matter how old your medical is by the time of your interview. As long as it was valid ( not older than two years ) by the time you submitted it you're good.

Since things have changed regarding your sponsor you'd have to bring a new I-864 and present it if asked. You can't be your own sponsor for the AOS except with funds in the bank or assets which could be added for the household. Your income doesn't count here so you'd better start looking for a joint sponsor or have things changed regarding this? Not sure myself.

This is not correct.  Yes, the primary financial sponsor on the I-864 is always the US citizen spouse, but a foreign spouse who has already entered the US on a K-1 and is adjusting status could be working in the US with an approved EAD--this income can be included on the primary sponsor's I-864 as the income is US-based.  From the I-864 instructions:

 

If you included the income of the intending immigrant who is your spouse (he or she would be counted in Part
5., Item Number 1.), you must provide evidence that his/her income will continue from the current source after
obtaining lawful permanent resident status. He or she does not need to complete Form I-864A unless he or she has
accompanying children.

 

Also, a new i-864 showing the current combined household income situation should be taken to the AOS interview, along with supporting documentation (most recent tax transcript, pay stubs for six months, employer letter, etc.).

So we will just need to prepare a new I-864 form with the supporting doc! This makes me ease a lot 😀😃

I just received a mail on Wednesday saying “If you submitted your form I-485 after November 1, 2018, the medical report and vacation record is valid for 2 years after the date of submission. If your appointment is more than 2 years after the date of submission, your form I-693 is no longer valid”. Damn! Mine is just 9 days passed 2 years! I checked some designated civil surgeons, some charges $800+, some charges around $400. What is the rough cost to do this in general?

That's a first. They might have mixed your category up cause

That's only valid for I-693 medicals performed inside the US.

 

K1 medicals use DS forms, so this rule doesn't apply to you.

Wow! I checked back my AOS application, we did submitted DS-3025 with the vaccination done in my home country, I also did the MMR , varicella and flu shot again after I arrived US. so I do not need this I693 form:) I will just bring all these records with me!
