Hi, 

 

my spouse has been waiting in India for CR1 interview. Her documents have DQ since May 2020. I was thinking about bringing her to US on tourist visa right now for 1-2 months as she has a valid tourist visa. Anyone have any experience? 
 

Also I heard that I have to write a letter to the US Embassy stating how long she will be here and why I want to bring here. Does any one know if that is true? If so where do I need to send that letter To exactly? 
 

Any help is appreciated.

It isn't true at all.  Misinformation is rampant out there on FB and Reddit.     People visit during the immigration process all the time.  She should be prepared to convince CBP that she will return to India.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Any help is appreciated. 

Yes, she can visit while waiting for the interview to be scheduled, at the discretion of CBP.  As long as she shows good evidence of returning to India to complete the spouse visa process, she should be fine.

 

I am not sure about the requirement for alerting the embassy.  If her interview was scheduled and she needed to reschedule, then yes, she would need to contact the embassy.   But while her case is still at NVC the US Embassy would have no knowledge of her.

Hi thank you for quick response. Any suggestion on what is considered as good evidence on returning back to India. Was going to show return ticket and employment letter? Anything else? Thank you

Return ticket is useless proof. They will possibly question the employment letter since 1-2 months is a lengthy vacation from most jobs.  Rent agreement, proof of other commitments would be helpful.

Agree employment letter, but type of job will matter too. A manager at a bank, say, gives a different kind of incentive to return home than something like a cashier at a grocery store. I always produced employment letters for my US visas back when I was in the position of having to apply for them, many companies there had a standard letter for visas that would detail: company name and address on letterhead, job position, how long you’d been employed there,  dates of leave granted and/or dates of business trip outside the country, that you remained employed and were expected to return after your travel, and contact details for HR.
