Filling Out I-751 Form Questions

Hi,

 

I am just getting ready to send in my i-751 ROC application. I have a few questions from the form as I am filling it out and hoping some of you may provide some clarity. I am a chronic over-thinker so I am sorry if some of these questions are dumb!

 

1) Part 1.  q 12. I am not sure what to put as my place of marriage. We did an a small official ceremony at a local park. Do I put the name of the park? The address? I looked through our marriage certificate and there was no address for where we got married on it.

 

2) What does "In Care Of" name mean for the address? That is just my name (the conditional resident) right?

 

3) Part 11- Additional Info- Do I need to fill out my name and A-number again if I have no additional info to fill out?

 

4) Should I put N/A or none for everything that doesn't apply? For example you can give other family names you've had. For one of the extras I put my maiden name, but for the 3rd extra one would i put N/A on every blank space? Or where it gives you spaces to write the physical address if it's different from themail box, or when it asks if you have children and gives like 3 pages of spaces to fill out their info? Would I just put n/a or non for all of those? Do I put them in every blank?

 

5) I don't understand the biometrics. I pay for it as part of my check, but then I might not need another biometrics appointment? I just want to be clear that it isn't something I am supposed to do ahead of time.

1. I would just put the city/state of where you got married. I sent mine in April and did not put my whole address of where I got married. 
 

2. That means if you have a mailing address somewhere different to your living address. You can leave that blank. In my case I have all my mail sent to my mother in laws house and have her name in that spot. 
 

3. unless you have any additional information on there you don’t need to worry about it. If you do then fill it in. 
 

4. I would put N/A, just in the past I’ve heard stories of people applications being rejected because of that. I’d just do it to be on the safe side. 
 

5. you have to pay for the biometrics fee. Typically you’re supposed to go regardless if you have been before. I applied beginning of Covid and my previous biometrics were applied to my case but they still kept the payment. It has to be part of the final total. No way out of it.

That helps so much! So did you put n/a on any blank spot that doesn't apply?

 

Also did you include any photos or affidavits?

City/state/country will do just fine.

If you are having it sent to a different address for someone to pass on to you (for example if you have no fixed address or are travelling), or care of someone else at your address, like your parents if you aren't there much or work away. 

If this isn't applicable then leave it blank.

N/A or blank. Doesn't really matter which.

I do know someone who put N/A in the middle name box and some mail or a card was printed as *first name n/a last name*.

Yep. Pay up to the USCIS wastage fund regardless of whether they require you to do biometrics agin.

If you don't enclose the cheque/funds to cover it, the package will be sent back to you.

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

 I-751 Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

I put N/A in all blank spots minus “in care of” I included photos but no affidavits. I included those in my AOS.
 

They want to see how you’ve both merged into life together. Try to include joint bank accounts, titles, leases, insurance cards and bills in our names at same address. I also included wedding invitations, birthday party invitations and cards between us both as a little extra. 
 

 

I used this as a guideline but also use USCIS website to cross reference. But this gives you examples of what to include and how to organize your packet.

Yes, we have lots of bills and such. Did you do a table of contents or just put everything in a folder and send it off?

When you applied, did you get the extension letter and then also a sperate letter informing you that your biometrics had be reapplied to this current application? 

 

How long did it take you inbetween filing and getting your 10 year?

I did a contents page but did not put it in a folder. You can but make sure there is no plastic wallets or anything. I kept it clipped together. Also make a copy of everything in case they lose things. They lost our marriage certificate in our AOS interview. I gave them a new one. 
 

Well during April onwards when we applied- there was a huge glitch and no one received their extension letters. It took me 65 days to get a copy!! They believed USPS lost it- this did not happen because all April/May filers did not get one! 🙄 anyways you should now get it within the accurate time frame. I did not get a biometrics appointment due to Covid and have my previous fingerprints applied. However, there are still people from April who have not received this or a letter as of yet. Expect for delays on this! 
 

I am in the process of ROC so can’t tell you how long it’ll take. Some people have been approved but that is down to luck!

Okay I’m not trying to be rude but I have stated 3 times I’m still in the process of ROC. So I can’t tell you what will happen. We all are expected to get interviews- things have changed a lot over the last few  months so just expect to be in this ready for an interview. 

 

For me I didn’t add slips just because they don’t have time to be pulling stuff out of slips. I’ve been on this for many years and seen people stuff be rejected. Just keep it simple. Clip things together in the correct order. You can pop it into a slip folder- something you don’t have to individually attach in. I’m not sure if they scan paperwork onto computers?? Who knows!. So try to make their jobs less difficult.

Folders etc will just be thrown away once your package is opened at the lockbox, they don't want those. 

 

I personally did not attach my documents with anything other than regular paperclips. I used sticky tabs at the bottom of the documents to separate the different sections of evidence, I had 10 tabs all in all (all three tax transcripts under one tab, all utility bills under one tab, all bank statements under one and so on). I also made a standard cover letter where I listed all the content and wrote the number of each tab. Keep it simple but organized. 

 

Tons of people don't get interviews for ROC. Since 2018 those who didn't have an interview for their AOS will have one for their ROC (although during the pandemic you could get away with not having an interview for both).

Make it easy for the case officer.  If you have a ton of stuff, group it together logically, and use ACCO clips (USCIS prefers this method, because that is how they store your paperwork) or big binder clips or paper clips or rubber bands to hold your groupings together.  I think a table of contents is great.  I made one, and it helped me because I used it as a checklist to make sure I included everything!

 

Everything is scanned.  USCIS hate to have to undo papers from plastic sleeves.  Also - only print on ONE side of the paper. 

 

And just another hint...if you are not using ACCO clips, and have something that is not letter size (8 1/2 x 11), tape it on a blank sheet of letter-sized paper.  That way, it is less likely to go missing.
