DECEMBER 2020 I-129F K-1 FILERS

It won't speed it up as such but your receipt date will be dated as December 17th (or thereabouts). SO if you receive the text/email/letter even at the end of March (I hope not!) then it just means you have already completed 3.5 months of the 5.5.-7.5 months processing time :)

Our lawyer let us know the credit card was charged on Monday so we will hopefully get ours soon! Annoyingly, I was looking back through the petition and he forgot (GRRRRRR!!!!😡) to check NO to a box. So an RFE is coming our way through no fault of our own. Frustrating and making me REALLY cranky. 

 

But oh well. Glad to see the process is moving for us :)

Our check was cashed and my fiance received the text message with our receipt number today! Planning to update my timeline here on VJ once we receive our NOA1 - would like to clarify something though, please let me know if these are correct and feel free to correct me. Thank you.

 

  1. For the NOA1 date, accdg. to the guide, I'll be placing the date under "Notice Date" - i.e. March 2021
  2. As for the processing time, I'll base my 'timeline' from when it was "Received" (Dec 2020) and not when they sent us the NOA1 (March 2021)...? (Aware that our embassy re: K1 visas is still at a stand still and is only processing mission critical cases as well as valid K1 expedites, just managing my expectations for this long process. I'd like to celebrate every small victory we have, even if that only means an approval behind a big backlog lol)

....... omg that’s what I was worried about too. We didn’t check it either. Are u sure it’s gonna be RFE?

About 95% sure, unfortunately! 😕 purely based off what people have said on here, an unchecked box tends to mean RFE, unless human error means they miss it? which I doubt will happen. 
 

But it’s ok! I see RFE as ‘they have opened your file, noticed an error and are giving us the chance to fix it’. It’s not an entirely negative thing! Frustrating, but not the end of the world. May add 2-3 weeks into the process but it should be ok :)

Relieved to say we finally received our NOA1!!! I almost vomited from relief I swear. My fiancé called me in the middle of the night to tell me!

I-129F received by lockbox: 12/29/20

NOA1: 12/28/20 (go figure they dated it a day earlier lol)

Isn't question 5 "If you are filing to classify your spouse as a K-3, have

you filed Form I-130?"

 

It's a yes or no, but if you are classifying spouse as K-1 (previous question) then I don't see a need to answer this question. Answering it would then assume you are classifying spouse as K3.

I sent my package on 12/07/2020 and it was received in the lockbox on 12/09/2020. I haven't heard anything back. My check have not been cashed . I emailed the lockbox support but they only replied with generate email( due to Covid delay) . I called but only reach robot or get cutoff without a case#. I am not sure what else to do. Any suggestion?

The best thing you can do is wait and have patience. If you look at some of the  request they process it's all over the place they are even doing some from November still. I was in your position not too long ago I would just give it a bit more.

12/11/20: Backdated I-129F "received date"

2/25/21: I-129F fee charged to bank account

02/28/21: Text alert with receipt # received

03/06/21: Mailed I-797C Notice of Action received

According to the case tracker app there was an application today that was processed with the date 12/9! Maybe that could be yours?!
