K1 National Interest Exception -Schengen Area

I received this email from Naples Embassy,  "If you believe your  fiancé qualifies for a national interest exception, please submit evidence on how your fiancé seeks to enter the United States for purposes related to humanitarian travel, public health response, and national security."

 

Anyone got approved for NIE? If so, what was your reason. Thanks in advance for the responses.

I have, my fiancée hasn’t gotten his visa as of yet. They are still waiting on a few documents to get to them. We were approved for NIE because I am pregnant with a high-risk. I also have a 1.5 year old so my fiancée who is in Germany has a US citizen child under 21, which was one of the exceptions from the travel ban.

If the 1.5 year old is his biological child then NIE technically not needed since he is already exempt to the proclamation as parent of US citizen child.

Yes he is his biological son. Well then I am not sure what’s going on... but the embassy said we were approved for NIE. We were in administrative processing for 18 months. Can you get approved for NIE if you are under administrative processing?

AP cannot be waived or expedited for any reason.

Sir/Madam, do you have any source to back this up? Or is it mare speculations? .....The most I know is embassies beside who goes into AP and for how long...if they decide she qualifies for NIE it is still their decision on what to do with her AP.

There are no exemptions for unapproved cases.  If a case is in AP (which means they do not have adequate information to approve/deny), the AP will need to be resolved before a visa can be issued.

Once again Sir/Madam says who... Give us sources... It's not about what you think that is happening... It's about how the the embassies work... She has been in AP for months before COVID now she qualified for NIE and she has been contacted by the embassy that her case is moving forward.

 

How do you know that don't have enough info presently?  Embassy decides who goes into AP and when you come out of it.. There are no set rules for AP as you claim, So how do you come about AP cannot be expedited?

 

How do you know that Sir/Madam ? 

 

Do you have a source so that we can all learn please.

I am not a sir.  AP/background checks cannot be expedited.  I'm not sure why you are harping on this, as this thread is about NIE exemptions from presidential proclamations.  The fact that one poster was able to get such an exemption to travel from the Schengen area makes it pretty obvious that her case was out of AP, otherwise that would not have occurred.

 

I promise you that visas cannot be issued until AP is completed.  I'm not going to look that up for you, but I'm sure you'll find it if you search hard enough.

Huh?  Who?  The OP said nothing about being pregnant.  Rose is pregnant, and has had her NIE approved, so obviously the AP for her case has concluded and the visa will be issued.
