OP said his ex-wife is a US citizen.  Assuming his ex was a USC and not a dual US-PH citizen at the time of their divorce, then OP does not need to go through the annulment process in the Philippines.  Instead, OP can file for Recognition of Foreign Divorce.  Though easier than annulment, Recognition of Foreign Divorce still involves a court case.  So your argument still stands -- it's going to take a long time for the OP to get this done.

By the time your 5 years is up hopefully you can have your foreign divorce recognized.

But #2 will be your biggest hurdle.

 

2. Because you married a US citizen to become a permanent resident, US immigration has put restriction of people of this category. And this restriction is that you ( the beneficiary) can't petition for a new spouse for 5 years after obtaining a GC through your previous marriage. So if you just became a PR a year ago, you still have 4 more years to go.

 

3. Even after you have met all the requirements (waiting 5 years, getting the annulment recognized in the PHL)... for you, the spousal visa process takes 2 years to complete.

 

So if you add in all of the time for that, you will start to see that it will be a long time before your GF will be in the US. My estimate is 5 - 7 years.

 

So i have to be a us citizen first before i get my gf and just make it a fiance? Can i do that?

Here are the steps to get your divorce recognized in the PH --

  1. The divorce decree granted by a foreign country must first be filed for recognition in the Philippine Regional Trial Court (RTC).
  2. Once the local court recognized the foreign divorce decree, register it to the LCRO of the place of jurisdiction of the RTC which granted the petition.
  3. The next step is to provide the copy of the registered court decree and certificate of finality to the LCRO where the marriage was registered for the annotation in the COM.
  4. Once registered, you may now request for an annotated COM at PSA.

You can't get a K1 as an LPR.   You can't get a spousal yet because you obtained your green card thru marriage.

 

You are going to have to be patient.  Get the Foreign Divorce taken care of.

You have to be a US citizen to be able to apply for a fiance visa for her. Again, that is a few years away from happening.

Hi Ryan,

 

You have several problems.   You have to get your divorce recognized since you are a Filipino with a marriage record there.  Also, this fits a classic pattern of marriage for a green card, quick divorce, and then going home to marry your true love so she too can have a green card.  

 

First, is your ex-wife a dual citizen of the US and the Philippines?  Yes or no.

 

Second, when did you get your green card?  Month and year.

Third, how did you meet your GF and when was the last time you were together?

Since you are divorced from the USC that petitioned youm - You have to wait for 5 years instead of 3 years to file for citizenship,

Geez, I hope this isn't true.   But I am not surprised how often it happens and that the beneficiary is usually clueless of how "it" works.

If you mean filing for a K1 visa or marrying in the Philippines, then neither option is available to you right now --

  • You cannot file a K1 petition for your gf because you are LPR.  That option is only available to US citizens.
  • You cannot marry your gf in the Philippines because you are still considered married there.  You need to get your foreign divorce recognized in the Philippines, if possible.  Is your ex-wife a dual US-PH citizen?

Since you have been a PR for such little time before you divorce. Expect a whole lot of scrutiny when applying for anyone else.
