Hi Guys,

 

My approved petition moved to NVC and they transfer it after 3 months to US Warsaw embassy(around 3 weeks before) but as per president proclamation (Ban on Schengen countries) consulate is not willing to take interview. I haven`t received any eligibility letter for interview or email which state that I can schedule interview now.  On "Ceac" my status shows ready but when I tried to contact consulate, they said that we cannot issue visa due to ban even if i promise to wait 14 days out of Europe. Is there anyone here who got there interview from Schengen countries ?  Any recommendations apart from wait ?

You can’t force the embassy to provide an interview. If they are refusing because of the proclamation, there’s nothing anyone can do. Do you have a minor child who is a US citizen? That offers a glimmer of hope in bypassing the ban.

There is a lawsuit filed against the US State Department due to the suspension of K visa interviews, the plaintiffs are all in your same position... there is a hearing on October 22nd that may require or encourage embassies to resume. The suit is titles Milligan v. Pompeo, and was filed in the District of Columbia District Court.  Stay tuned! Hopefully we will see positive results!

You can force the embassy to provide an interview via Milligan vs. Pompeo.

There has been no ruling on this yet. It’s scheduled for PI hearing later this month.
