Hello everyone. How everyone is doing well during these unprecedented times. I do have a question to ask.
I was wondering if my husband will qualify for expediting his interview. He is supposed to interview in Ciudad Juarez, our cc was exactly 1 year ago this month and we have yet to received any type of notice, And with this pandemic it has delayed many things for us and many.
Now, My husband was recently diagnosed with a rare kidney disease, I would love to see if this will expedite him to get his interview sooner as he’s closely monitoring by his specialist.

Please let me know your thoughts

thanks in advance.

That’s a double edged sword. Having a “rare” disease only makes him at a higher risk for becoming a public charge in the US; make sure you are able to find good health insurance to present. They also look at the totality of circumstances and depending on your income/i864 this will hurt your case. It’s up to you if you want to bring it to their attention: let us know how it goes.

I thought as of July 29, 2020 there is no "public charge" and no longer have the need to get health insurance.  Well that what my attorney told me at least.  I do think your husband qualifies for an expedite.

Best of luck and keep us updated.

Thank you for your reply. I will definitely try, I feel like this can’t be kept a secret to them since he’s gonna have to have a medical examination by one of their doctors in Ciudad Juarez.

This is correct, as of right now at least while the “pandemic” is still being considered a pandemic the courts decided to put a stop to the public charge rule. Hopefully you are able to expedite. We too are on the same boat, this month marks a year of out case complete and nothing. Which with the consulate closing on March 19th, the last now almost 5 month technically have not counted considering they have not been scheduling appointments or anything for immigrant visas. Best of luck

Thank you. I’ll try, what’s the worse that can happen? They’ll just say no but at least we tried.
Yes, I totally understand. Let’s hope we hear something soon.

I have a similar situation, my husband who is the beneficiary and has just been diagnosed with cancer.  We are in the process at CEAC but some people say that the request to expedite applies to the petitioner's situations. Share your experience after your request .

I’d be careful with that, make sure to get a co sponsor, cancer is a very pricey illness. They can still try and use that against you and yes for the most part they care about the petitioner, however you can use the angle of how this is affecting you! You need your husband to have the best medical assistance possible, and it’s not like you’re going to let him go and deal with it alone abroad, just like you can’t stay home and take care of him yourself 24/7 because someone has to pay the bills. I’d speak to a lawyer, a consultation at least. You can pick their brains and see what your best options are. Anyway, I hope your husband is doing well, wishing you two the very best
