Comments : UPDATE: 09/08/2020
After many emails and calls to USCIS, got an email 09/04/2020 asking that I send them a copy of the I-130 application along with attachments. I dont have a complete copy of the application so I asked my attorneys office to send what they are requesting. The file has been MIA since March 2020 but ironically only 1 of my stepsons file got sent to NVC and the other 3 files (incl. my husbands) have not. I have even called and emailed USCIS about the error they made (since 05/2020) but they still have not been able to correct the issue.

#FRUSTRATED

After my local immigration office has had my file since March 18,2019 I finally got a interview. Had interview on November 18, 2019; the officer did say I was going to get an RFE where he was going to request more information to prove "bona fide". The documents that he mentioned at the interview that he needed copies he did not mentioned in the letter.

Question: We have an attorney processing our I-130 application. He filed in early Aug. 2018 and our file was currently at the Potomac Office. When he filed the application he didn't submit a lot of evidence showing bona fide marriage/relationship other than my plane ticket when we got married. Back in early Feb. 2019 we got a letter stating that our file was transferred to the National Benefit Center. It's been over 7 months now and still no response. Wondering if the delay is because he did not submit enough bona fide evidence? Anyone that might have an idea? Thank you.

You might want to give them a call and ask them what’s going on!

Hello! Do you have any news?

Hi @ L??F, Still nothing...I have put in a request check the case as the processing time has passed our PD. They are to get back to me in 30 days (rolling eyes)... Also, I gave my senator authorization to inquire about my husbands application. They were told that the files have been transferred to a local office for an interview and that was about 3 weeks ago. I have not received a email/letter with a status of nothing. Thank you.

That is so awful. I hope everything works out for you and after the interview they should proceed a speedy service on your case.

UPDATE: Received a letter yesterday (dated 10/31/19) from USCIS (local office) letting me know that I (Petitioner) have an appointment at the Immigration Service Office in 2 weeks. This interview may be video taped which makes me very nervous. I hope all goes well.

This is common to happen?

Have you guys managed to collect your documents for the RFE?

Since I had plans him meeting my husband early January the attorney wanted to wait until get got back to give him more picture for our RFE. We still have not sent the RFE because now he wants me to do my taxes showing that claiming that I am married (will probably do that this weekend).

*Notice about estimates: The estimates are based off averages of other members recent experiences
(documented in their timelines) for the same benefit/petition/application at the same filing location.
Individual results may vary as every case is not always 'average'. Past performance does not necessarily
predict future results. The 'as early as date' may change over time based on current reported processing
times from members. There have historically been cases where a benefit/petition/application processing
briefly slows down or stops and this can not be predicted. Use these dates as reference only and do not
rely on them for planning. As always you should check the USCIS processing times to see if your application
is past due.
