Filing Single or Married Filing Separately

I am in the situation where my accountant is ready to file my taxes but if I file married filing separately she says it will take 4 - 6 months to be processed by the IRS since it has to be mailed in.

 

My questions:

(Note: I cannot get the tax transcripts due to being out of the country and not having a US phone number)

1. When submitting my tax filings to the NVC does it matter if it has been processed yet or does it just matter that I have filed them? 

 

2. If I file as single now (and later amend the return) will that impact my wife's ability to get her visa?

 

3. Are there other things I am overlooking that I should consider?

 

4. What is the best course of action here?

If you were married in 2019 you file married.

File Married - Filing Separately.   You are not single. Do not commit perjury on your tax form.   Surprised that you accountant would even entertain this.

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

Intentionally filing a false tax return can be seen as perjury......File as married...

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Yes, it seemed strange to me, she's been pushing hard that without a TIN or SSN I can't file as married until I sent her links showing that it could be done.

 

Odd.  Anyway, thanks for the confirmation of what makes sense to me!

Accountants can be the worst for filing taxes.  I had one go to jail for 20 years!  But I did meet a great tax attorney that way.  I ended up selling my business after a divorce and I ended up taking a bunch of H&R Block Tax prep classes for personal and business so that I had a better understanding of what was going on.  I think I was the only one doing it for fun!

Do you qualify to file as Head of Household? This is your only other option if you don't want to file married filing separately or jointly.

Kinda a red flag if they weren't even aware of this. It's right in the 1040 instructions for filing status, not hidden anywhere.

MFJ, MFS, and HOH (in limited cases) are all valid options for somebody who is legally married. Single is the only one that absolutely excluded.
