Hello,

I got the following letter for my mom's AOS. Initial instructions did not mention that I had to send the I-693 with the application.

Does this mean I have to get the immunizations done right away and send the records to USCIS ?

or- Does this mean that I have to take the immunization records and form i-693 at the time of interview?

Thanks

The I-693 is not required at the time of filing. It should be brought to the interview, if she has one, or else they will issue an RFE for it later if they decide to waive the interview.

No action is needed at this time.

I think the action is to get the immunization done and have the I-693 ready filled by the doctor right?

Those will be necessary, yes. But it does not mean to do it right now either. It's just a courtesy notice that it will be needed later.

Generally, the reason you don't submit the I-693 with the AOS packet is because it can expire while waiting for them to make a decision.

Thanks very much; so at what point should we get the immunizations done and have the form filled? should we do it after the bio-metrics?

Personally, I would wait for the interview notice or the RFE (if they are going to waive the interview). You can't submit the I-693 until either the interview or you get the RFE anyway.

But for something like a parent i130 expiry shouldn’t be an issue, it’s two years now, it’s the 60 days between signing and receipt that needs to be watched more closely I thought? People I personally know have submitted to front load in hope of interview waiver.

Under the new policy, which affects Forms I-693 filed after November 1, 2018, applicants will be required to submit the Form I-693 to the USCIS within 60 days of the date that the civil surgeon signed it. However, such a properly submitted Form I-693 will remain valid for two years instead of the previous one year. This means that once the Form I-693 has been properly filed, it will remain valid for two years from the date of the civil surgeon's signature while the USCIS adjudicates the application. If the application is still pending after those two years, however, the applicant would need to obtain a new Form I-693.

Regardless, as you rightly point out, now the only options are interview or RFE. Zero point doing it until petitioner knows interview date or gets RFE because of the 60-day clock.

Yes, they increased the validity timeframe to 2 years when signed within 60 days of being submitted. So not filing the I-693 with the initial AOS packet is less useful than it used to be. Filing it at the same time as AOS had a good number of new medicals being needed prior to that change.

An interview waiver would not be conditioned on the I-693. As noted, they would just send an RFE if that was the only item needed to approve the application.

Agreed - there's nothing to do now until they get the interview notice or an RFE for it.

Yes, but it would take extra time. ... they send RFE, medical, wait for someone at uscis to lodge receipt of RFE...

That bolded part is incorrect. Completed I-693 can be older than 60 days of when I-693 is submitted to USCIS; see middle row of chart below. Completed I-693 can't be more than 60 days older than the date of I-485 filing. https://www.uscis.gov/policy-manual/volume-8-part-b-chapter-4

Form I-693 Submitted to USCIS On or After November 1, 2018

When did civil surgeon sign?

I-693 retains evidentiary value through

No more than 60 days before applicant filed underlying benefit application with USCIS

2 years from date civil surgeon signed I-693

After applicant filed benefit application with USCIS

2 years from date civil surgeon signed I-693

More than 60 days before applicant filed benefit application with USCIS

N/A – I-693 not valid at time applicant submits I-693 to USCIS

I got a request for initial evidence letter for my fathers AOS case

It is asking for his birth certificate. I had already submitted it when applying for i-130 and the I-130 was already approved.

I just send a color photocopy of the same again?

Always treat a petition or application on it's own; i.e. each should have it's own set of documents. Furthermore, his birth certificate wasn't required for I-130 petition, only for I-485 application. I-130 required your proof of US citizenship and a "copy of your birth certificate showing the names of both parents. Also submit a copy of your parents’ marriage certificate establishing that your father was married to your mother. If either your mother or father were previously married, submit copies of documents showing that each of the prior marriages was legally terminated." https://www.uscis.gov/sites/default/files/document/forms/i-130instr.pdf

Good point about submitting the marriage certificate... again I had submitted that along with  the I-130 application but will send it again... Thanks
