  1. We received the 48 Month extension letter on 9th Feb and still waiting for the next notice about Biometrics. Should I be concerned that it has been a month since the NOA1 and still not given the biomertics notice? The online status only shows the case received and NOA1 sent. I checked with ask emma live agent and they said - when the case is ready for biometrics they will send us a notice... It looks un-usual. Anyone else in the same boat?
  2. Bumping to see if there are any opinions /suggestions? I am trying to reach ASk Emma /call uscis but wanted to see your suggestions/recommendations. It has been a month since we received the NOA1 and we are still waiting for the biometrics notice..... I see most others getting biometrics reuse or biometrics appointment much sooner after the NOA1.

  5. Thanks for the input. Yes we wanted to get her school documents to show the changed name so we went ahead and did the name change. Now the question is - if the extension letter comes with the new /changed name and the expired green card shows the old name then would that pose a challenge while traveling internationally?
  6. Hello We are about to submit our I751 documents in a couple of weeks. I am the USC sponsor and my wife and her daughter (my stepdaughter ) are the applicants. I have a question about the dependent daughter's name change The dependent daughter turned 18 during the conditional residency period and changed her name in her home country ( India) through that home country's legal process. While filing the I751 form can we enter the daughter's changed name ? We can also attach the supporting documents that show the legal name change done in India. Her passport is still with her old name and so is her conditional green card. We would like to get the 48 month extension letter and the 10 year green card to show her new changed name. Is that possible?

  8. The guidelines mention the day that the conditional resident status was acquired.. won't that be the the date- residence since "M/D/YY" on the green-card itself? In other words would it matter if one card was delivered via the USPS on a later date than the other if both cards have the same - residence since date. "If you have dependent children who acquired conditional resident status on the same day as you or within 90 days thereafter, then include the names and Alien Registration Numbers (A-Numbers) of these children in Part 5."
  9. I see, but the difference in the days the mother received the card vs the daughter received the card was about 80 days...
  10. Hello I am looking for guidance on whether to send out a separate application for the 18 yo daughter or send out one single application for the mother and the daughter. From some of the earlier posts I noticed that if the green card was received over 90 days from each other then we should send out two separate applications. In our case- both the mother ( my wife) and the daughter ( my stepdaughter) were interviewed together by the same officer on the same day and have the same issue and expiry dates on their conditional green card. BUT the physical card that the daughter received was after 95 days of the date of interview vs. her mother received her card in about a month from the date of interview. Would it still be okay to send out one single I751 application? Thanks
  11. Thanks! yes that makes sense if the I131 has be applied from within the USA. I was thinking if they can re-purpose the biometrics for the I751 and may not need another biometrics for I131... any thoughts on that..?

  13. @Lil bear@OldUser @nastra30@powerpuff and other experts.. seeking your thoughts on this great suggestion provided by @Dashinka . Would this potentially work fine? Also I believe my wife can follow the same plan- file for the I751 , then I131 and travel to USA to get her bio-metrics done.... then come back and visit USA again if and when she is called for the I751 interview?   16. I see, thanks. I do have close relatives/contacts in USA who can help. So the first I797 NOA might be either for the removal conditions or for the re-entry application..? She hopefully has to only do one set of biometrics... And also she should get the extension letter in 4-6 weeks after after filing I751. She can collect the extension letter before leaving the USA...? does that sound about right?
  17. I did not quite understand that sequence. Can you please clarify a bit more. I am trying to evaluate how long of a break she should take from her ongoing studies in India to maintain her LPR. So she first she goes to USA now and files for the I-751. Stays in the USA until she gets her extension letter and biometrics appointment. Does her bio-metrics, files for re-enetry and then travels back to India? Or She files the I-751 while she is still in India, then travels to USA when she gets her biomertics appointment. Does the biometrics and apply for re-entry permit and comes back to India? Thank you so much for such a generous work you are doing to help families with this guidance.

  22. I was wondering if having a GC in the past is considered negatively while obtaining a student visa? also typically all student visa applicant's are of marrying age isn't... And we ( all her family) will be in India when she goes for her student visa interview... but yes your reminder helps me to think this through. Thanks
  23. Myself USC, the wife and the step daughter both with conditional green card ( expires in April 24) are all currently staying together in India. We thought of an idea which I wanted get assessed here- The daughter wants to study in India for a few more years ( 2 to 3 yeas) she prefers to come to USA only after her undergrad is done in India. In this case can we execute the below plan?- 1. both the wife and the stepdaughter give up the GC by filing I-407 now 2. The stepdaughter applies for her student visa in 2 years 3. The wife applies for her new spouse sponsored GC and times it such that she gets it about the same time as and when the step daughter will got her student visa 4. We then all move to the USA in about 2 to3 years Does this look feasible? The motive is we will get to live all together in India and then in USA with this option.Also we have our 2 year old US born daughter who is half sister to the stepdaughter and the more they live together the better they can bond with each other.   24. Thanks you Dashinka and Nastra for those insights. I should have added a few more important details to my question. The daughter is already studying in India and her conditional green card will expire in about three months. She would need to study for another two years in India to finish her undergraduate. She did not apply for re-entry permit while leaving the USA as she was not sure of when she would come back to USA in future. At this point she thinks it might be better to give up the LPR and apply for a student visa when she is ready to do her further education in the USA. My question really is- Assuming the daughter gives up the LPR, and her mother ( my wife) applies for the daughter green card through family quota will that hinder the daughter's chances of obtaining a student visa or visitor visa in future?
