Case returned to NVC

Timeline

Please i need help. I filed a i-130 petition for my spouse and child on the 26th February, 2020 at the US Embassy in Seoul, Korea. I received an email from the embassy on the 3rd March,2020 saying my petition is “Clearly Not Approvable” and that the petition is being returned to the States. Its past 30 days and i have not received any mail or nothing whatsoever from USCIS. I checked the CEAC status and it says “Case Returned to NVC”. I dont have a receipt number from USCIS. I only have a case number which was in the email received from the embassy in Seoul. The USCIS case tracker wont accept the case number i have. Please what do i do to know the status of my petition and where it  will likely be( USCIS or NVC). Thank you

Sorry about all that...but to answer your question we need abit of background knowledge of what could be the problem...you can help us by first filling your timeline. I also see you are a naturalized citizen, your timeline will help us know when you naturalized so we can answer or advice you correctly

Seoul stopped accepting i130’s on feb 1 2020... you were meant to send it to the Dallas lockbox.. the below link says they’ll redirect your application to USCIS lockbox..

Seoul USCIS has been closed since 2/1.  Obviously you did not file it at the USCIS FIeld Office.   Unless you are active duty military or have exceptional circumstances, the consulate does not accept I-130s or most other immigration matters directly.   If a Seoul case number is attached to it, the petition will not be traceable in USCIS.

 

You may wish to consider stopping payment on the fees and file it at the lockbox in the US.

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

I am active duty military and i was told i could file directly at the embassy in Seoul

You have to contact the consulate's immigrant unit first and then they will provide directions on how to process it.

You were authorized to file at the Embassy -- there is an automatic permission to do so for active duty personnel. 

 

However, the consular officers can only deal with the I-130 petition  if it is "clearly approvable", i.e., there are no issues that require review (for example -- criminal convictions, unclear/unverifiable documents, etc. ).  For some reason, the consular section determined they could not approve your petition and sent it to NVC for forwarding to USCIS.  This return process can usually take a couple of months and maybe take more now, with COVID slowdowns.  You might try to e-mail NVC to see if they can tell you if/when they have sent your paperwork to USCIS.
