I have a stepdaughter and her son that would like to come to USA ! How can I get them here and what visa should I be filing for them ! She is not married and 26 yrs old ! Child is 2 yrs old! They are from the Ukraine !!!

What does that mean??? Does she want to visit or she wants to live here? That is the most important question. If she only wants to visit, then the only option she has is a visitor visa.   Bu

What age was she when you married the mom? I assume, from the k1 in your profile, already an adult. That means you cannot sponsor her, but her mom can sponsor her when the mom gets a green card, as long as the daughter remains unmarried. That would probably be a 5-7 year wait for their immigrant visa (category F2A). The son can be a derivative on her petition.

But if she wants to immigrate there needs to be more info,

You file an I-130 and they will get visas under F2B.

Edit: More specifically, her LPR parent would file. You could only file if she became your stepchild before she turned 18 (and it would F1 instead of F2B then).

No such requirement exists anywhere...unless you are referring to naturalizing under the 3 year rule? But that's not required to petition a son/daughter.

Would need father's permission (or sole legal custody) eventually. But at the moment nobody can file I-130 for your stepdaughter. After your wife gets her I-485 approved she can file I-130 for her. Then there is 5-7 year wait for F2B visa for her and derivative visa for the child.

 

Edit: Or are you now asking about custody relating to B-1/B-2 tourist visa issuance and travel?

Thinking about it ! But I did the test on the wed site she has only 13 % chance of approval ! It also states I-130 5 months to a year wait time

That's petition processing time. Then as F2B category, she has to wait for Priority Date to become current: https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin.html That's the part that takes years: https://www.nolo.com/legal-encyclopedia/free-books/fiance-marriage-visa-book/chapter8-4.html
