Renting an apartment with pending k1 visa

Timeline

I'm planning on moving into an apartment and I have a pending K1 petition awaiting my NOA2. Would I want to add my foreign fiance to my lease or just get the lease in my name 100% and then add my fiance when she finally gets here? I wouldn't want her to come here and then get denied and not have anywhere to stay but I also don't know if its even possible to get her on the lease or accepted before she even gets here. Any advice would be appreciated. =]

I wouldn't recommend putting her on the lease until you are married. You don't even know if your I129f will be approved...

Would I want to let the landlord know at least that she will be coming eventually or just let them know when she gets here? What are the chances they would deny her because shes an immigrant? Is there a specific type of apartment I should be looking for?

Look at the apartment lease ahead of time to see what it says about additional residents.  There should be a standard clause in there.

 

As for your first question:  Avoid doing anything that carries the force of law before you're married.  However, turn into a whirlwind immediately after you're married.  Just about the first thing that I/we did was to draw up Wills, powers of attorney, HIPAA releases, and similar documents.  These are crucial to have in "life," and they're outstanding evidence when she's removing conditions on her green card.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I would probably let the landlord know that you are engaged to a foreign national and she will be immigrating to the US and then be getting married. 

 

Some places like to run background and credit checks on their tenants...I doubt they would be able to do so on your fiance. 

 

Another issue is liability. If she signs the lease she will be liable for damages, rent and dues. What happens if you lose your job?

The lease on my current apartment has a place to put the names of people who are allowed to live in the apartment, in addition to those who signed the lease. So that kind of thing could be option if you prefer to simplify the potential complexities of unexpected events. I don't know if that kind of arrangement would raise suspicion during the later AOS process, so it could be worth it to later get a written modification to the lease when you are ready to both sign.

I just rented an apartment that I plan on having my fiancee move in with me there when she gets here. I did have a co-signer for the apartment. I let my property manager know about my fiancee and the whole situation. She told me that as long as my co-signer (in this case my mom) accepts responsibility for her it's fine. I think it's not a big deal in my case since technically there is already two people on my lease.
