Question about NVC required documents I-864W or I-944?

Timeline

I am a US Citizen living with my wife and my son in Vietnam.

 

On Sep 12 2019, USCIS received my I-130 petitions for my wife and my son.

On Sep 17 2019, Date of I-797C (NOA1) We got IOE case numbers (1 for my wife and 1 for my son)

On April 09 2020, my I-130 for my son got approved, and nothing for my wife.

On April 10 2020, I received NVC email for my son with Consulate case number and receipt number. On same day I made payments for AOS (Affidavit of Support) and IV (Immigration Visa) fees

On April 15 2020, Payments cleared. And I could the the list of required documents to submit.

 

On Feb 24 2020, the Final Rule of Public Charge Ground of Inadmissibility has been implemented.

 

My son is 22 months old. My questions is:

At the time of application submission,  I did some research and learnt that I just have to submit I-864W for my son because he is under 18 of USC. After the NVC fee payments, in the AOS section, they require to submit I-864 or I-864W,... and Tax Returns

I've learnt that I-864W has been eliminated. And I don't see anything about I-944 in this section. What should I submit?

 

Any help is appreciated.

Why don’t you submit I-864 so you can use this for your spouse also.

First, if bringing two immigrants, you need an affidavit for each, in spouse of US Citizen cases.  However, this child is eligible for US Citizenship upon arrival, so there is no requirement for an affidavit of support.  There is no open question about the spouse.  Until very recently, the child would need an I-874w, (w for "waiver") but that form has been discontinued.  

 

It's a very good question, I don't have an answer for at this time.

 

For those who don't know, this is a natural child of a US Citizen but the US Citizen does not qualify to pass citizenship at birth by way of a Consular Report of Birth Abroad.  In this case the child needs an IR2 visa but instead of a green card on arrival, they become a citizen and can just apply for a passport.

 

Unless somebody knows the answer, I would call NVC directly for guideance.

I currently live abroad with my wife and my son. And even if I had foreign income, it would be excluded on my tax return (<$105,900). So my total income is still "0".

I have a joint-sponsor for my wife. And his income is just enough to sponsor 1 person. My wife application is still pending so I don't wanna disturb him on my son's.

The new Public charge rule came in ruins my plan.

It's hard to call NVC amid pandemic, especially from Vietrnam. I submitted I-864W and wait for instruction from NVC

Not a bad plan.  It might even work.

Hello. I am having the same case as your son. I have submitted ds260 and civil documents and left AOS incomplete. Did you get reply from nvc after submitting 864w?

Thank you for your response. I am very confused how to deal with AOS section. Maybe i should upload i-864w even if that document is outdated.. Please post here if you get any responses from nvc.. :)

A QUICK UPDATE FOR YOU GUYS:

FOR MY SON:  ONE MONTH AFTER I SUBMITTED I-864W AND ALL OTHER CIVIL DOCUMENTS. I RECEIVED A MESSAGE ALL PAPERS ACCEPTED AND DOCUMENTARILY QUALIFIED. AND NOW JUST WAIT FOR THE INTERVIEW APPOINTMENT.

 

FOR MY WIFE: I-130 GOT APPROVED ONE MONTH AFTER MY SON DESPITE OF SAME PRIORITY DATE.

                           I SUBMITTED AOS PAPERS (ME AND A JOINT SPONSOR) AND CIVIL DOCS AND GOT RESPONSES A DAY AFTER REQUESTING MORE PAPERS FROM ME (PETITIONER)

                           I SUBMITTED REQUESTED PAPERS YESTERDAY AND WAITING FOR NEW RESPONSES.

 

FOR MY WIFE CASE, NVC DID NOT ASK FOR THE AOS FEE. MAYBE THEY SAW THAT I PAID THAT FEE IN MY SON'S CASE. I DON'T KNOW FOR SURE BUT IT SAVED ME SOME 1XX.00 DOLLARS

 

I HAVE SOME QUESTIONS IF SOME ONE CAN HELP

1) they will never be merged because they are two separate petitions.  

2) you should have waited to complete your son, but regardless they should still interview together.  The NVC knows the cases are together because you only paid 1 AOS fee

A QUICK UPDATE:

BOTH MY WIFE AND MY SON ARE DOCUMENTARILY QUALIFIED. 

WE ARE IN LINE WAITING FOR INTERVIEW APPOINTMENT NOW.

US CONSULATE IN VIETNAM OPENS INTERVIEWS FROM 06/29/2020.

HOPEFULLY WE WILL HAVE OUR APPOINTMENTS SOON.
