SSN while pending AOS

Timeline

We did not apply for SSN for my husband before submitting the AOS/EAD and we did put 'yes-on the question if we want uscis to issue ssn to him-on the form'. My question is can we still go to SS office now and apply to get him a number or we have to wait until we get his EAD? We still have 2mons before his 90days expire.

Go in with the i94 and k1visa  before day 75

Be prepared to ask to talk to a supervisor if the staff member erroneously says "You can't get a social security card on a K-1 visa" or "you can't get the card because you already got married"

what should we say if they ask why he needs a SSN? On the website it states there should be a valid reason for applying for ssn for nonwork purposes, and we have no other letter or anything to provide if they ask for it. Should we select "legal alien not allowed to work"or "Other" on the citizen part of the from?

For the first 90 days, a k1 is a "legal alien allowed to work"

 

Many moons ago. A k1 was routinely given a work authorization stamp by the CBP upon entry but that practice has stopped

He's entitled to it as a K-1 visa holder to ease his transition to the USA and make it easier for him to get a bank account, get a state ID card or driver's license, get health insurance, be added as a joint filer on your tax returns, be added to you utility bills to show it's a bona fide marriage.  K-1 visa holders can't work until getting EAD but they are treated as eligible to work for social security purposes under the I-94, it's in the SSA manual.  He's eligible for a SS card, and the fact you are married already doesn't change that.

Bring a copy of his I-94 printed from the website and bring his passport AND his birth certificate.

However, a k1 is eligible to submit an i765 under category (a)(6).  

 

They don't give a hoot about "easing" the transition into the USA.   That is NOT why they are eligible

And the SSA doesn't care that it takes more than 90 days to process an I-765. You're legally able to submit one, ergo you can get an SSN.
