Hi,

I am married to a US Citizen, we have a baby together who was born here, I was on a student visa (F1) until I got pregnant. I stopped going to school when my son was born, and applied for green card  year later because we didnt have the money to apply immediately. I just got my i485 denied.

Will I have to leave my family and go? I havent recieved a notice in te mail yet. Will they let me apply again?

May I ask what was the reason for your denial? That can help us help you better if you reapply in case a mistake happened.

You were on a F-1, didnt go to school, OUT OF STATUS for a year I think.   You are not in a normal I-485 adjustment situation.   May want an attorney if you can afford it.

Depends why you were denied.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

Most AOS denials we see here on VJ are because of insufficient evidence that the marriage is bona fide.  What evidence did you send with the AOS package?  See what the letter says when it arrives, but while waiting, I recommend that you do more research, read up on bona fide marriage documentation, and gather more evidence of financial co-mingling so that you are ready to re-apply with a stronger package.  Good luck!
