I certainly agree that a joint sponsor MIGHT be warranted........

Frankie, TECHNICALLY they cannot ask for your tax returns prior to the filing date of April 15th.  Here on Visa Journey, we have seen people with March interviews asked for their prior year tax returns.  These people are usually folks who have borderline financial qualifications.  They MIGHT want you to file 2018 tax returns before they clear you over the next hurdle.  But you might not need them.

 

If you were significantly over the threshold in 2017 and 2018, they may not blink, and you might get by.  But if you were close, they will look a little closer.

 

Because you ARE borderline, you can do a couple of things to prepare.

 

1.  As most people have said - line up a co-sponsor.

2.  If you are NOT going to file your 2019 returns prior to the interview, then you need to get a letter from your employer stating when you started your job (September 2019), and what your hourly rate is, and what your annual salary will be. 

 

If the questions about 2019 earnings come up, you will have to be honest and say you haven't filed yet.  If they ask you what your approximate earnings will be for 2019, YOU MUST NOT LIE.  You can say that you changed jobs in 2019, that you have a great new job, and then produce the letter from your employer stating your salary.

 

Just so you know - if the questions come up, you will most likely be required to find a joint sponsor.  I want you to prepare for the worst - so start asking around.

So if they are looking to dig deeper, they will notify me before the interview? (i.e we want more supporting documents?).

 

  I submitted the affidavit of support and paid the visas fees all together, they only contacted me a couple of weeks after to say that they also wanted a divorce certificate from my last marriage, after that they changed the status to accepted, and its been a month since that, so does that mean everything was good to go and now im only waiting on a interview date, or are they still looking over my affidavit of support?

The Consulate Officer has the final discretion to accept your financial documents regardless of whether NCV accepts them.

If you didn't file it yet with IRS and just calculated it at home then no issues.

 

If you already submitted it to IRS then that might be trickier as others said. In theory they should be fine with the 2018 if her interview is before 15th of April and u didn't do your taxes for filed for an extension (providing the extension letter)

Having a good job since Sep. 2019 works in your favor, especially if it will put you well over 125% of the poverty line. Last year matters less than your *current* financial situation. I was worried when I started the K1 process in 2018, because my income for 2017 was very low (I was voluntarily unemployed for 6 months in 2017 due to some health issues) however I started a new salary job in January 2018 that put me well over 125% of the poverty line. We never encountered any issues, because by the time the interview came around I was able to show significant proof of my current steady income.

 

Just be honest about the situation, and make sure you have proof of your current earning capability (including 4-6 months worth of paystubs). 

 

Are you certain your current income is at least 125% over the poverty line for your household size (you + fiance + any children, usually)?

Hi, we just had our interview (but in Sydney).  I used 2018, as I haven't done 2019 yet, and it was fine

im all for being honest, but i just dont want to put my foot in my mouth, i dont want to bring up that i already did my 2019 taxes if its not nessesary, i would rather go in there with just my 2018, and my current job pay stubs, if they dont have access to the irs database and would not know that i already filed, i dont see why i should have to tell them i did so

That's dishonest. You bring in the most current tax return. You do know USCIS does tend to check this website right?

He should bring his 2019 return (all pages), plus his paystubs and a letter from his employer.  He should NOT volunteer them unless specifically asked for them.  You always tell the truth - but you only answer the questions put to you.  Be prepared, be honest, and answer what you are asked.  I really had to coach my spouse on this - because she is long-winded and volunteers info that she is not asked.  We got through!

 

Our interview was on April 13th.  We were not asked for the prior year's taxes.  However, we were more-than-well-above the poverty line.
