Out of curiosity, for the more experienced VJers, are there any repercussions for stating there are no children in the original 129F?

 

Just find it a bit strange, we emphasize the need to be accurate/truthful with our petitions. I personally re-checked mine several times before I submitted our petition. This seems to be a major omission.

~~Moved to the PI forum, from K1 P&P - The topic of custody and what is needed is country specific. Also the speed needed to process a Follow to Join would depend on how fast Manila works.~~

Well at that time I don’t have the right to say yes to my husband what he needs to do.because he knows his gonna bring my kids here so he wants to include them but he just confused what is the best. Thats why he stick to say NO

I'm not questioning his confusion nor sincerity, but whether there are any repercussions of filing an 129F with a significant omission such as if the beneficiary has any children?

The question about if you have any children is about if you have or not, simple. It is not about whether you want to bring your kids with you. So “YES” was the correct.

 

What is done is done, now pursue i130 and be ready to have a good response in case USCIS or embassy catches that mistake and asks about it. Just don’t make such mistakes moving forward.

None.  It's a mistake, not any intention to hide anything.  Furthermore, it's not material.

You came to US on a K1 visa?

Your children were listed on your USC's initial I-129F visa petition?

You are now married to your US petitioner?

You have filed your AOS and received your 2-year conditional Green Card?

 

It would be very helpful for other members to comment on your situation if you provided more information. Your timeline is vacant, :time:

They are consideed "Follow to Join". Fill out a DS-160 for each of them and then schedule medical, interview and CFO as needed.

June 13, 2018 Mary receives Mexican Residency Card

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

September 25, 2018 Interview in CDJ and Approved!

First I will address the children and custody;  Being you never married the father YOU have sole custody of the children, you need NOTHING from the father to bring your children to the USA.

 

The children should have been listed on the I-129F whether they were applying for visas or not.  At this time that is a moot topic being it is water under the bridge.

 

You timeline is blank so I have to ask - How long has it been since you were issued YOUR visa?    It may be possible to complete the K-2 .. but that is a BIG "may" being the children were not listed on the I-129F.

 

So let's go with the I-130 petition approach.  To start the process your husband should file an I-130 petition for EACH child.

Do you have copies of each of their birth certificates, no you do not need these to file the I-130 petition, I would suggest your review each BC to make sure there are no TYPOS in their names or yours is the reason I ask.

It has not been a year since your visa was issued.   I would for sure contact the embassy about completing the K-2 FOLLOW TO JOIN (much cheaper and quicker if you can complete this).   Explains your "oops" regarding not listing the children ... mistakes happen.   You would not be the first that didn't realize you needed to list the children.

You really think that OP who got her K-1 on January 8, 2019, has time to contact the US Embassy to reopen the case to add children who were never declared on the I-129f, schedule interviews, and have K-2 visas issued by Jan 8, 2020?  With Thanksgiving, Christmas, and New Year interrupting normal business?

Yes I’m married to us citizen and yes I already file aos the only question I need my husband did not includ my kids at that time. Coz of the income so if individual for I-130 it’s okey for me to process

Don't know, but without trying one will never know ... they are out nothing to check into this and have everything to gain.     And yes .. it can be done 

 

What is your philosophy?  Accept defeat before you try?    

 

They are not the first omit listing a child on the I-129F.
