Dreaded RFE

Well, 

Just got the dreaded RFE on my K1. I thought I had loaded my 129f application well and I included signed letters of intent, pictures, flight info, hotel info and everything else requested. 

They are now wanting, "More evidence of the bona fide nature of your and the beneficiary's intent to marry within 90 days". They also want evidence of wedding preparation? Just how can you plan for something you don't even have an approval for??

Luckily, I just returned from a 2 week trip for visit my fiance for the second time. I will send them what they asked for...again. 

My question is: They sent a small envelope to return the information, which of coarse id too small. Can I send in a larger envelope and would I send it registered with return receipt?

Yes you can use a larger response envelope. Just put the RFE letter on top. However you want to send it is fine, but something with tracking is preferred.

 

Is that the only thing they requested? Did you provide the signed letters of intent (one from each of you, or a single letter signed by both of you) with the original petition?

A seperate one from each. I have new updated ones. They are seperate bit reaffirm our intent.

Gotcha. Maybe they lost the originals...it;'s unusual to ask for intent alone when proper letters were provided originally.

They asked for any other proof also. But not sure since I loaded the packet the first time.

I will just send all the stuff from the latest trip.

I would suggest your first packet wasn't "loaded" if you had only met her once. A single meeting may meet the bare minimum requirement for filing a petition but such petitions showing only one meeting are often viewed with skepticism. It's good that you have visited her a second time.

Her country is not a HIGH FRAUD embassy so it's not necessary for more then one meeting. Yes, two or more meetings does lend more credence on a relationship but most who are applying do not have the luxury. So since the requirements are one meeting within two years prior, they met the requirement. Their problem is the lack of evidence of an ongoing relationship. What USCIS is asking seems to be something that a "newbie" agent would ask for as the OP has supplied what was necessary and what most have supplied and received an approval on. Just my opinion.

It's a form letter generated by boxes ticked in a program. Just send new updated letters of intent and evidence you sent before. On your cover letter state that you are RESENDING the information that they requested and had sent before. Like GB said there are varying levels of experience and thoroughness found in adjudicators at USCIS. But as GB also likes to say those who have the gold make the rules.

Its just a let down to put so much into the application only to have them request more.

I had modeled my application from others on the site and added even more information than was requested. 

Luckily I have had the means for a second trip to visit and I  did think ahead and had updated intent letters for her to sign in case they asked in the interview.

Just adds more time to an already lengthy process. But, we are just pawns to their rules...

Responding to the letter by just re-sending what was sent before and assuming the person who sent the letter was a newbie or inexperienced person who made a mistake in sending the RFE seems like a really bad idea to me.

I don't know why you would say that "most" Americans who petition for K-1 fiancees have only met them once and don't have the "luxury" of meeting them twice. Requesting to marry another person after meeting only one time is the exception, not the rule.  It may meet the technical bare minimum in person meeting requirement under US law,  but it causes the entire petition to be scrutinized much more closely than that of a couple who has spent a lot of time together.

Because I have been here long enough to understand this issue and those that I help, more times then not, have met at least once but rarely more. Those who live in VWP country's have the luxury of traveling back and forth. Those who live some 18 to 24 hour travel time away and are not VWP fall into the category of  one time meetings.

Greenbaum is incredibly knowledgeable about PI specific immigration matters. He is correct that most petitions with a beneficiary in the PI only have one meeting- almost always the USC going there; PI also has one of the highest rates of K1 approvals if not the highest- so its not an issue there. 

 

@AlaMike Didnt you just post about the bad CFO experience>? Im so sorry you are having such a tough time with the whole thing! Hang in there! Hopefully it gets better.

Yes, bad experience with CFO office, then get home to an RFE. Man, my luck.

But like they say... If it were easy, everyone would do it.
