I was listening to John and Ken yesterday and he was going on an on about the fire yesterday. I guess him being so close really affected him.

I like Culver City overall because they seemed like they had their act together in regards to managing the city. I have a friend and a former coworker who bought a house there in the 80's and now gets cash offers for 1.2-1.3 million even though she hadn't renovated it since then.

Culver City is well-managed but it's also one of the only places left that still have red light cameras. You have to be very, very careful because those tickets are very pricey. A good friend of mine was born in Culver City, and his grandmother's two bed house, untouched since the 70s, fetched $1.5m last year when she passed away. It was levelled and now a new build is going up.

My boyfriend sent me this yesterday evening:

We're all good here. I left the office at lunchtime when the smoke got too bad; there's only a slight tang hanging in the air now. We had a pretty calm night on the Westside wind-wise. I live near Culver City and it was completely clear when I headed out to work in the morning, but by the time I hit Olympic and Bundy it was like staring down a valley with a grey wall at the end of it. Today, not so bad.

It's a distinction without a difference. Really. "Not necessarily interchangeable" is some weasel-wording, and Larry O'Connor -- a radio host without a law degree -- does not state the grounds on which he premises that they are "not necessarily interchangeable" in the first place. It is important to ask who is telling you things, and the basis for their propositions. If it's Posner or Volokh or one of the guys at Lawfare, fine. A radio host without a law degree with a background in theatre management? Maybe not, without sourcing. His sole sort-of source is Joe diGenova, who isn't exactly the most reliable source. He's a conspiracy theorist with a law degree, and he himself appears (from that Washington Times piece) to be basing his own allegations on the old "someone told me" line. Who? Who told you, Joe? Again, look to the messenger. What are their bona fides?

And we will probably never know what the basis for recusal is, as I mentioned, because Contreras doesn't have to say, and custom is not to say.

Wasn’t it the court spokesperson that used the words “was recused” or “has been recused”?  It would seem if it was voluntary it would have been “recused himself”.

It is a distinction without a difference in practice. Really. Think of it this way -- "has been recused" is inclusive of both voluntary and involuntary recusal, while "recused himself" embraces only voluntary recusal. We do not know the reason for the recusal. So it is proper to say "has been recused" under either set of facts (voluntary or involuntary recusal). I ran this line of thinking past two attorneys in my office just now and they agreed -- it's meaningless to get hung up on this. I didn't mention we were speaking of Contreras, by the way, so that any possible bias in that regard would be avoided. :)

Yes, stay safe.  I was in CA last week, but in the South Central East at Death Valley.  Luckily, not much fire danger there at the moment.

I still want to know who tortfeased.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
