* Moved from IR-1/CR-1 P&P to Tax and Finances During US Immigration where similar questions are asked. The topic of the question is primarily about taxes, not immigration specifically. *

The applicant, your spouse signs it as they are the one supposed to fill it out. Have him/her sign and mail it back to you its a simple form. Otherwise then yes i suppose you'd have to have power of attorney as you cant sign for your spouse. Yes on the passport copy.

So, i am going to ask her to send documents to me, are these only 2 things that i need from her in physical form ? Did you go through this process as well? Thanks a lot

Hi!  No I looked in to the process but did not go through it. My husband is here and adjusting status so is eligible for social security number.  You will need other supporting documents proving who your spouse is and connection to the foreign country. Please read page 2 of the link I gave you. It says what is needed. Also there is a number for you to call if you have additional questions. It is 800-829-1040 if in the US.

You file the W-7 to get an ITIN when you file a tax return.  I went through this with my spouse when we filed our 2018 tax return as married filing jointly.  At that time he lived in Brazil, and he did not want to send his passport by mail for me to send with the W-7, so when we were in London together in April we found a Certifying Acceptance Agency, basically a registered accountant who filled out the W-7 at Heathrow Airport with an attached certification that she saw his passport, attached a copy of it, and then she filed our 2018 tax return with the W-7.  So the W-7 has to be filed with a tax return.  Good luck!

Thanks 4 sharing ur experience, So, you cannot apply w7 ahead of time, you need to wait till tax return time, Correct?

yes, you file for ITIN together with tax return
