Timeline

Hi, my daugther has expired k2 visa, she reached 21 yrs old and still in the philippines, what will we do if we still want her to be with us? Do we need to file a new petition for different type visa?

You now have to file an I-130 for her.

March 2, 2018  Married In Hong Kong

April 30, 2018  Mary moves from the Philippines to Mexico, Husband has MX Permanent Residency

June 13, 2018 Mary receives Mexican Residency Card

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Unfortunately there's a long wait for her. 10+ years. You have to file an i130 petition for her. She will be under the F2B category. She has to stay single otherwise she'll wait twice as long.

another thing, i have read in k2 limitations that k2 holder cannot changed any other non immigrant visa if you have k2 record it will be a violation  as what it says.. i am confused, does this I-130 will apply on my daughters case?

There is no such thing as changing from one visa to another.  That does not exist.

 

Your daughter can apply for a different visa and that has nothing to do with the K-2 visa.  A K-2 visa shows immigrant intent which will make it harder to get a non-immigrant visa.  

 

Filing for the I-130 is not filing for a visa or changing visa - the I-130 is only a petition to see if the beneficiary is eligible to wait to apply for an immigration visa in the future when the PD becomes current.   About 10 years after you file the I-130, your daughter can then apply for an immigration visa.

You are filing for a family reunification Visa.  File the I-130 and wait, wait, wait. Category F2B unless she gets married.
