Do you think I can still be RFIE/RFE for me to mail to them the original PR card? So it looks I will have to do the Biometrics for sure? I want to get a good picture. Is it OK to tell them to re-take the picture if I am not satisfied with the initial one that they take because the updated picture will be used on the new card right?

It's possible to get a RFE at any time, for any application/petition while it is pending.

Yes.  They've already scheduled you into an appointment as your case status reads.

 

They will take a new photo.

I see an envelope in the informed delivery. Must be the biometrics letter.

I didn’t receive the biometrics letter. It was another receipt that had the billing info. All $0. Why would I get this in 2 different mails?

To show that you weren't charged for the replacement since it was a DHS error.  As for why 2 separate receipts, might be a clerical error/duplicate receipt sent out, might be that this is how they issue the i-90 receipt now---one showing submission of the application, one showing any billing details.

 

Either way doesn't affect anything, if just another receipt notice sent, nothing to stress out about.

I should get the biometrics letter by end of this week right?

 

How many re takes of photos can I do at the biometrics? I want a picture that I am happy with.

Realistically expect 1-3 weeks at least, if all goes as expected.

I suppose as many as the agent is willing to retake.  It's more about the photo satisfying their requirements, though, not your own.

The biometrics agent isn't there to judge how your emotions come across your face during photo-taking...the agent is there to make sure that the photo and fingerprints is acceptable by USCIS requirements.

 

I guess my advice would be to think happy thoughts when facing the camera, then?

I once had a green card with no expiration date. After ten years, INS and then CBP get threatening me that there was a new law "coming any day" that would outlaw such green cards, and " I better do something about it." After each threat, I checked with the DHS web site and found that the CBP officers were lying (cops lie, who knew!).

 

After the straw that broken the camels back, I did the I-90 thing. And I when they took my photo at the USCIS office, I was angry, and the yes indeed the biometrics agent noticed, and asked me if I wanted a new photo. "Nope, I like it as it is." She looked at my old green card, and said, "wow, CBP must have really given you a hard time".

 

(The point of a fingerprint on a green card is lost on me if the thing expires every 10 years.)

 

Never had a problem with that new green card at POE again. Even worked for Global Entry. 

 

So I say, embrace the anger.

 

BTW, I am amused that your lawyer didn't send in your green card, and you didn't get an RFE. I guess lawyers are worth it some times. 😉
