Stepchild receiving free lunch

Good evening, 

 

My stepdaughter that i petitioned for is now living with her biological mother during her removal of conditionprocess. My concern is that my stepdaughter brought it to my husband's and I's attention that she is receiving free lunch. Which us federally funded. Can I be penalized for this as i signed an affadavit of support? Im also not sure if she is using her to get other public assistance.

Are you talking about the free lunches/breakfasts provided at public schools?  No, you can't be penalized for this.  Eligibility for the national lunch program is based on the household size and income of the home the child resides in while attending school.

 

Depending on where the child is living, some major cities offer the program to all students regardless of household income now.

Yes I believe thats the program. I just want to confirm because i know getting government assustance can fall back on me like food stamps etc

I know NY wiped out the eligibility/application factors completely and now offers free lunches to all students regardless of household size, income, etc...no forms for parents to fill out, all the child has to do is line up to be served..  I believe other major cities like Boston, Chicago, Detroit etc. no longer determine the need based off of income, either.

The free lunch program is not a means tested benefit. She'll be fine.

Florida needs to follow suit. 🙄

The only free food in Palm Beach County schools is breakfast. Lunches are $2.05 in Elementary schools....not sure if it differs at Middle/High schools.

No you should be fine. My daughters entire elementary school is provided with free lunches due to the low income area. It's not something you get a choice over.
