Hello,

I need SSN, can I apply during the process?

I’m on the process of AoS, EAD and AP. My case was restarted (from RFE)on March 5th.

My husband need my SSN yo file tax return,

I could apply for ITIN through the agent but he doesn’t want to pay for them but wants wait for my SSN with EAD

I don’t think I can get SSN without his 2018 tax return, since he changed work in January, so we’ll need to submit the tax return before get SSN.

I hope ole anyone knows this, I couldn’t find on the internet and my husband never acts for this things.

Thank you in advance.

You can apply for SSN at the same time you apply for EAD  only thru i765 itself. You’ll get SS card only after your EAD is approved.

I hope ur husband filed for the extension. For ITIN, isn’t the service at IRS TAC locations for passport copy certification free??

your husband can file married filing separately if He doesn’t want to pay or go thru the hassle to get your ITIN. MFS has to be paper filed. You don’t need ITIN or SSN for that.

Did you came here thru K1? If you did the only time you can get a SSN is when you have your EAD. You can get your own ITIN. Read thru the IRS website and I hope your husband requested for an extension to file taxes.

I say the only time you can get your SSN is when you have your EAD - this is because you already passed the 90 days on your I-94 which you could have used to get a SSN.

Thank you for your comment. I applied for SSN with EAD, but I don.t think I can get those since he only submitted his pay stubs of January, and letter from his  workplace. I don't think it's enough USCIS decided to EAD so I want SSN.

And yes, I could apply for ITIN, if I could send my "original" passport to IRS in TX from Hawaii that I live in now, but I don't want to send my passport there.

so I need help by the agent for $300.

Okay, I will look up about MFS.

Yes, k1. yes, I read IRS and about ITIN, but, he doesnt want to pay for the agent and I don't want to send my passport to IRS in TX. so IM writing here to know if I can apply for SSN even though I applied it with EAD

Without at least 14 days of a legal status remaining (i.e. within the first 76 days of entry on a K-1 visa), you don't qualify for an SSN unless you have an EAD or a green card.

You can file MFS now and write in "NRA" for your SSN/ITIN. You can then amend your return to file jointly once you do get an SSN.

If you have your EAD you can get an SSN. I don't see any problems with that. Go to the nearest SSA office near you and apply for SSN. Bring your EAD and other requirements needed. https://www.ssa.gov/ssnumber/

That's what I understood when I applied for EAD with SSN.

I should tell my son about MFS. Hope he will do that or he doesn't want me to get EAD

Sorry, What do you mean?

I can't work in the US.

If you are filing a joint tax return with your husband, whether you can work in the USA is immaterial.

Let me rephrase the question: is the joint tax return your husband wants to file going to have a refund (or zero dollars owed)? If so, you have three years to file to get that refund.

To clarify the above, there's a period to file in order to get the refund. But the requirement to file still persists regardless of of refund or payment required (there's just no tax penalty if a refund is owed).

My husband said he doesn’t owe.

I just want to him to file tax return of 2018 sooner to get EAD, AP and Greencard.

Thank you for clarifying.

I hope I can talk about this with my husband but he doesn’t care for my AOS thing, so I have to do whatever I can do...
