Error on approved I-130 - please help!

Hi all,

 

My husband and I received our noa2 recently. However on the letter it said that the petition indicates that I (the beneficiary) am in the US and we are filing for AOS. I’m not in the US and am in the UK. I then figured out that my husband must have gotten onfused when filling out the mountain of forms because, when I looked at photocopies of what we sent, in Part 4 Section 61a-61b where it asks for details for those applying for AOS within the USA he put his location/city. Then in the next section (62a-62c) which is for those who are applying for a visa from outside the US (which we are doing) he left it blank.

Is there any way we can sort this and get it sent to NVC without having to file form i824? I looked online and it says the wait for i824 approval is up to 11 months and we can’t wait that long! I know it’s our error but the last thing we want is it to be delayed or to file our i130 again and wait another 6 months...

I’m devastated by this and so embarrassed that we made such a stupid mistake on our form. What can we do?

Call USCIS and ask to speak to a Tier 2 officer. See if they can change it. That's the only thing I can think of. Otherwise, it's the I-824....

Thank you. I’m waiting for a new sim with cheap international dial rates to arrive so I can ring them, otherwise it’ll cost me £1.75 a minute. 

My husband spoke to someone today who had no clue though, she said ‘well I think maybe it’s gone to the nvc’ which ofc it hasn’t. 

I just really don’t want to start again or have to wait super long for the i824. If the wait time for it wasn’t so long I’d be a bit annoyed but would just send it. I’m so angry for making this stupid error in the first place.

Use Google talk. It's free to call. I use to live in Nigeria calling USCIS and NVC daily.

Yeah, you can use google hangout or google talk or simply gmail on the computer to call a US number for free. 

 

However, my understanding is one has to submit i824 to get the approved petition out of USCIS if it was originally meant to stay there.

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US
