Former j1 Student Visa

i am a former J1 student visa holder, my program ended on October 29 2018 and thats where i met my fiance. i went back home to the Philippines after my program to graduate. my fiance visited me in the Philippines 3 months later and that when he proposed and when we decided to apply for a K1 Fiance Visa. would my previous student visa affect the visa we currently are applying for?

 

My J1 visa is not subject to the Two-year home country requirement, but we did not declare it on our petition packet.

Those in J-1 status (and their J-2 dependents) can become subject if any of the following apply to the J-1 program:

1) If the J-1 receives funding from the U.S. government, home government or an international organization to use for the J-1 program.

2) If the J-1 worked or studied in a field that appears on the "skills list." This is a list of fields of specialized knowledge and skills that are needed in the J-1's country of last permanent residence for its development. Canada, Australia and Germany are examples of countries that are not on the list. China, India and South Korea are examples of countries that have many skills on the list.

3) If the J-1 participated in a graduate medical training program in the United States under the sponsorship of the Educational Commission for Foreign Medical Graduates.

 

 

my visa is not under any of those 3. it is also indicated on my visa itself and DS 190. 

 

we were unable to declare it because we forgot about the 2 year home country requirement and we're worried it might affect our application

Most J's do not have a 2 Year HRR.

I met my fiancé when he was on his J1. Everything was fine and we were approved. I think it’s better because you physically spent much more time getting to know each other. Send plenty of proof. Which was easy for us because we had so much time together. Good luck.

Make sure you declare in your DS-160 that you had a J1 visa.
